Rights and Obligations
The President of the Republic of Tajikistan is the head of state . Many of the powers of the president are either directly executive, or as close as possible to the executive branch .
The President of the Republic of Tajikistan is the guarantor of the Constitution of the Republic of Tajikistan , human and civil rights and freedoms , sovereignty , integrity and unity of the state, as well as the supreme commander of the Armed forces of the Republic of Tajikistan . In accordance with the Constitution of the Republic of Tajikistan and republican laws, the President of the Republic of Tajikistan determines the main directions of domestic and foreign policy .
Procedure for election and assumption of office
A candidate for the presidency can be a citizen of the Republic of Tajikistan at least 30 years old (until 2016, the age limit was 35 years old), who speaks the state language (that is, the Tajik language ), and has been resident in Tajikistan for at least the last 10 years. According to new amendments to the Constitution of the Republic of Tajikistan , adopted after the results of the 2016 constitutional referendum , the President of the Republic of Tajikistan has the right to run for this position an unlimited number of times. Previously, the same person had the right to run for this position for no more than two consecutive terms. A candidate for the presidency may be registered a person whose nominations have collected signatures of at least five percent of voters. The President of the Republic of Tajikistan is elected by the citizens of the Republic of Tajikistan [1] .
Elections of the President of the Republic of Tajikistan are considered valid if more than half (i.e. more than 50%) of the electorate have taken part in them. A candidate for the presidency is considered elected, for which more than half of the voters who participated in the vote voted. The procedure for presidential elections is determined by the constitutional law of the Republic of Tajikistan [2] .
Upon assuming office, the President of the Republic of Tajikistan takes the oath of allegiance to the people [3] in Tajik:
“I, as president, swear to defend the Constitution and laws of the republic, guarantee the rights, freedoms, honor and dignity of citizens, protect the territorial integrity, political, economic and cultural independence of Tajikistan, faithfully serve the people” [3] .
The oath is taken in a festive atmosphere at a joint meeting of members of the Majlisi Oli and Majlisi Namoyandagon of the Republic of Tajikistan [3] .
The President of the Republic of Tajikistan does not have the right to occupy another position, be a deputy of representative bodies, or engage in entrepreneurial activity [4] .
