The body of guardianship and trusteeship (guardianship authority) in Russia is the state executive authority [1] of the subject of the Russian Federation [2] , which is responsible for guardianship and trusteeship . They operate within the framework of the federal law “On guardianship and trusteeship” [3] , which, as amended in 2009, allows these functions to be transferred to local governments (Article 6, paragraph 1).
The duties and rights of a guardianship body extend to the sphere of relations related primarily to guardianship and guardianship over minors left without parental care, as well as adults with incapable (partially capable) persons.
The functions of the tutorship and guardianship include the supervision of the rights of minors (including those with parents), the settlement of disputes between parents related to the competence of the tutorship (disputes about parenting, establishing the name of the child and some others), control over the management of property wards and some other issues.
Russian legislation protects the rights of minor children when conducting real estate transactions, including mortgage transactions. Such protection leads to small restrictions in conducting transactions and the need to take additional actions. These actions consist in the need to coordinate the transaction with the guardianship authorities.
The guardianship authorities have the right to take children away from any person, including parents, to protect the life and health of the child, identify children left without parental care, arrange for such children to be placed in families or specialized institutions . The guardianship and trusteeship bodies give citizens conclusions about the possibility of being adoptive parents , guardians , foster parents, foster parents.
The guardianship and trusteeship bodies, as a rule, have territorial subdivisions in each municipal district (or in the inner city municipality).
