The 1995 Berlin Constitution replaced the constitution on September 1, 1950 . Significant differences from the old version are in the second section, where the number of fundamental rights was increased, and a ban on discrimination was introduced. In Section III, the rights of members of the European Parliament have been expanded, and a data protection officer has been established. Section V established the right to organize national referenda. Finally, Section VII laid the foundation for the Constitutional Court of Berlin.
The 1950 Constitution proclaimed its sovereignty throughout Berlin, including the eastern part of the city .
