The Supreme Court consists of 5 members appointed by the President of the Republic with the consent of the Parliament. The tenure of judges is not limited.
The main function of the Supreme Court is to consider complaints against decisions of the High Court of the Maldives, which is a court of appeal [1] . The Supreme Court is also considered as a court of first and last resort in cases relating to serious constitutional conflicts, disputes between authorities, as well as in matters of constitutionality of laws and acts of the President of the Republic [2] .
In addition, the Supreme Court is authorized to determine the procedure for considering cases in the courts of the Republic. Maldives legislation defines only the basic principles, while the procedure is described in detail in the rules adopted by the Supreme Court.
The Supreme Court also has the right to seek legal proceedings from any lower court to verify the legality of the procedure for its consideration. At the same time, the Supreme Court has the right to give binding instructions to lower courts regarding compliance with the legislation of the Republic. The Supreme Court also has the right to verify the legality of the deprivation of liberty of any person in custody or arrested in the territory of the Republic.
Parliament has the right to ask the Supreme Court for opinions on any matter relating to its powers. In this case, the Supreme Court is obliged to answer the questions raised.
