The post of “ marishal of Scotland ” was hereditary in the senior line of the Kate clan, since Hervey de Kate (d. C. 1185), was called marishal under Kings Malcolm IV and Wilhelm I. Hervey's descendant, Sir Robert de Keith (d. 1332 ), was confirmed as the great marishal of Scotland by King Robert I Bruce around 1324 .

The descendant of Robert de Keith, William Keith (d. 1463), became a peer of Scotland, receiving in 1458 from King James II Stuart the title of Earl of Marishal. In 1715 , when George Kate, 10th Earl of Marishal, joined the Jacobite rebellion , the British government confiscated his titles and possessions.

The Earls of Marishali were supposed to keep the royal regalia of Scotland and protect the person of the king when visiting parliament. During the War of the Three Kingdoms, William Kate, 7th Earl of Marishal (1614–1671), harbored Scottish royal regalia at Dunnottar Castle .

The title of Count Marishal was confiscated in 1715 due to the participation of the 10th Count Marishal in the Jacobite rebellion .
