Citizenship of Azerbaijan is the citizenship of the Republic of Azerbaijan , the norms of which are governed by the law on citizenship of the Republic of Azerbaijan. A citizen of the Azerbaijan Republic is considered to be a person who has political and legal relations with the Azerbaijan state, as well as mutual rights and obligations [1] .
History
The concept of Azerbaijani citizenship first appeared in the year of the existence of the Azerbaijan Democratic Republic . The Citizenship Regulation was adopted on August 23, 1918 by the Government of the Republic and was in force until the adoption of the law the following year. The law on Azerbaijani citizenship was adopted on August 11, 1919 by the Parliament of the Azerbaijan Democratic Republic [2] . The law included rules and regulations for determining, granting and losing citizenship. According to the first paragraph of the first chapter of the law, regardless of nationality and religion, all citizens of the former Russian Empire who themselves or their parents were born on the territory of the Azerbaijan Democratic Republic were considered ADR citizens. The law had a corresponding clause, according to which all people who accepted the citizenship of the Azerbaijan Democratic Republic should take an oath of allegiance [3] [4] .
The law lost its force on the day of the fall of the Azerbaijan Democratic Republic, April 28, 1920.
This Law
The current law on citizenship of the Republic of Azerbaijan was adopted on September 30, 1998 by the then president of the country, Heydar Aliyev. In subsequent years, the law was amended, namely in 2005, 2008, 2014 [5] , 2015 [6] , 2017 and 2018 [7] [8] .
The regulation on the rules for considering issues of citizenship of the Republic of Azerbaijan was approved by presidential decree of August 30, 1999. This law was also amended in 2006, 2008, 2009, 2010, 2015 [9] , 2016 [10] and 2017 [11] .
The right to citizenship
In accordance with the current decree, as well as Article 52 of the Constitution of the Republic of Azerbaijan, each person born in the territory of Azerbaijan or one of whose parents is a citizen of Azerbaijan is a citizen of Azerbaijan.
In accordance with Article 53 of the Constitution of the Republic of Azerbaijan, a citizen of Azerbaijan under no circumstances is deprived of his citizenship
Citizenship
Regardless of the grounds for acquiring AR citizenship, it is equal for everyone.
All persons who were citizens of Azerbaijan prior to the entry into force of the law of September 30, 1998, were not citizens of Azerbaijan until January 1, 1992, but were registered in the territory of Azerbaijan, as well as refugees who settled on Azerbaijani territory from 1988 to 1992 were considered citizens of the Republic of Azerbaijan at the time of adoption of the current law.
A child who was born in the territory of the Republic of Azerbaijan, whose parents do not have citizenship, is a citizen of the Republic of Azerbaijan. Also, a child who was born in the territory of the Republic of Azerbaijan and whose parents are unknown is a citizen of Azerbaijan [12] .
Admission to citizenship
Stateless persons, as well as foreigners who have been living in Azerbaijan for 5 years and speak the state language of the Republic of Azerbaijan, regardless of race, nationality, origin, political and other convictions, can accept Azerbaijani citizenship at their personal request [13 ] .
Required Documents
To obtain citizenship of the Republic of Azerbaijan, the following documents are required:
- autobiogaph,
- statement addressed to the President of the AR,
- 4 photos 3x4 s in size,
- certificate of residence on the composition of the family,
- receipt of state duty payment,
- certificate of knowledge of the state language of the AR,
- Permanent residence permit in the territory of the Republic of Azerbaijan,
- identification,
- certificate of source of income [14] .
