Prosecutor General's Office of Azerbaijan

The prosecutor's office of the Azerbaijan Republic is a single centralized body based on the subordination of territorial and specialized prosecutors to the Prosecutor General of the Republic of Azerbaijan . According to article 133 of the Constitution of the Republic of Azerbaijan , the prosecutor's office, in the manner prescribed by law, monitors the implementation of laws, as well as in the necessary (prescribed by law) cases, opens criminal cases and conducts investigations, initiates lawsuits, and also protests court decisions [1] .

History

On October 18, 1918 , in the first year of independence of the Azerbaijan Democratic Republic, the Council of Ministers adopted the Regulation on the Judicial Chamber of Azerbaijan. In the years of the ADR, the general prosecutors, as well as the ministers of justice, were Fatali Khan Khoysky , Halil Bek Khasmamedov , A.Safikyurdsky and Teymur Bek Makinski. The ADR Trial Chamber included all prosecutors of the Baku and Ganja Courts. After the collapse of the ADR on April 28, 1920, the prosecutor general’s office, like all other bodies, was abolished [2] .

On July 11, 1922, a decree “On the State Prosecutor's Office of the Azerbaijan SSR” was adopted, and thereby the Soviet prosecutor’s office was created. During the Baku commune, the Commissars of Public Justice were Ali Heydar Garayev, S. Chivanov, B. Velibeyli, G. Hajiyev, Y. Mamedov, who were also general prosecutors.

In 1936, the Prosecutor's Office of the Azerbaijan SSR withdrew from the subordination of the People’s Commissariat of Justice , and already subordinate only to the USSR Prosecutor's Office began its almost independent activity.

In 1955, on May 24, the Regulation on Prosecutorial Supervision in the USSR was adopted, which played an important role in the development of the prosecution system. And on November 30, 1979, the USSR Law "On the Prosecutor's Office" was adopted, which served as the Charter and the activities of the prosecutor's office were carried out on the basis of this law.

In 1991, Azerbaijan regained its independence, although in the early years it was weak and, as you know, there was no single judicial system.

On December 7, 1999, the Law "On the Prosecutor's Office" was adopted, which reflected all the provisions on the body [3] .

Attorney General

The head of the prosecutor general’s office is the prosecutor general.

A general prosecutor can be a citizen of the Republic of Azerbaijan who has reached the age of 30, who has a law degree, has the right to participate in elections, and is fluent in the state language of the Republic of Azerbaijan.

The Prosecutor General may not engage in any activity (entrepreneurial, commercial or other paid activity), except for scientific, pedagogical and creative.

The head of the prosecutor general’s office is appointed and dismissed by the President of the Republic of Azerbaijan with the consent of the Milli Majlis of the Republic of Azerbaijan. And his deputies on the proposal of the Prosecutor General are appointed and dismissed by the President of the Republic of Azerbaijan.

Other territorial and specialized prosecutors are appointed and dismissed by the Attorney General of the Republic of Azerbaijan by mandatory agreement with the President of the Republic of Azerbaijan .

The powers of the prosecutor general include organizing the activities of the prosecutor’s office, submitting proposals on the establishment or liquidation of prosecutors, approving the structures of other prosecutors, convening a board of the prosecutor’s office of the AR, military prosecutors, the prosecutor’s office of the Nakhichevan Autonomous Republic, as well as other prosecutors, concluding international treaties with law enforcement agencies of other countries and international organizations etc.

The duties of the Attorney General also include informing the National Assembly , as well as the President of the AR, about the activities of the prosecutor's office.

Under the Attorney General there is a scientific advisory council, the composition of which is approved by the Attorney General. The position of the council is also approved by the attorney general.

Board of the Prosecutor General

The advisory body of the Attorney General's Office is the College, which is also led by the Attorney General. In addition to the Attorney General, the board includes deputies of the Attorney General.

Meetings of the advisory body of the General Prosecutor's Office are convened by the Prosecutor General. The meeting discusses the activities of the prosecutor's office, the fight against crime, draft acts and orders, as well as other important documents. During the voting, all members of the collegium have equal rights.
