Real Estate Ownership Partnership

The Real Estate Ownership Partnership (TSN) is the organizational and legal form of non-profit organizations. According to part one of the Civil Code of the Russian Federation, this is “a voluntary association of owners of real estate (premises in a building, including in an apartment building, or in several buildings, houses, country houses, horticultural, gardening or dacha land plots, etc.), created by them for joint ownership, use and within the limits of the law on the disposition of property (things), which by virtue of the law are in their common ownership or in common use, as well as to achieve other goals provided us "(paragraph 1 of article 123.12) Error in the footnotes ? : Missing closing tag </ref> .

With the advent of TSN, regulations governing HOAs are not abolished. The activity of the HOA is still based on the housing legislation - the Housing Code of the Russian Federation (its norms are special in relation to the general provisions of civil legislation on TSN).

In accordance with the legislation of the Russian Federation, the following should be included in the TSN charter:

  • about his name, containing the phrase "real estate partnership";
  • its location;
  • the subject and purpose of this partnership;
  • composition and competence of its bodies;
  • the procedure for making decisions by such bodies, including on problems, decisions on which are taken unanimously or by a qualified majority of votes;
  • other information provided by law.

The partnership is not responsible for the obligations of its members, and the latter are not responsible for the obligations of TSN. TSN can be transformed into a consumer cooperative by the decision of its members.

Ways to manage an apartment building

According to the current legislation of the Russian Federation, there are such ways to manage an apartment building [1] .

  1. Direct management of the owners of the premises in an apartment building, which includes no more than 30 apartments.
  2. Management with the help of homeowners association or housing cooperative or other specialized consumer cooperative .
  3. Management through a management organization .
  4. Office TSN.
