Constitution of monaco

The Constitution of Monaco (Constitution de la Principauté) is the main law of the Principality of Monaco , which has the highest legal force in its territory. The Constitution was granted by Prince of Monaco Renier III on December 17, 1962 and replaced the former Constitution of Prince Albert I of January 5, 1911 [1] . Adopted with the aim of improving the institutions of the principality, which should "better meet the needs of good governance of the country" and "meet the new needs caused by the social evolution of its population" [2] .

It consists of a preamble and 12 titles, divided into 97 articles. He entrusts the Prince of Monaco with a dominant role in the administration of the principality: proclaims the inviolability of his personality and gives him not only the executive, but also the judiciary (he delegates it to the courts and tribunals) and part of the legislative power (shares it with the National Council ) [3] . Thus, the Principality of Monaco is a full-fledged dual monarchy [4] .

Constitutional control is exercised by the Supreme Tribunal. Revision of the Constitution is possible by agreement of the Prince and the National Council. Amendments are accepted by 2/3 of votes of Council members.

In April 2002, at the initiative of Prince Rainier III, amendments were made to the Constitution, providing for the possibility of the inheritance of the Throne not only by children, but also by brothers, sisters, nephews and nieces of the monarch [3] .
