Civil Military Administration

The Military Civil Administration (CAA; Ukrainian ; Vіskovo-civil administration, VTsA ) is a temporary state authority in Ukraine , operating in the Donetsk and Lugansk regions . The CAA is subordinate to the Anti-Terrorism Center at the Security Service of Ukraine and is designed to ensure the operation of the Constitution and laws of Ukraine, ensure security and normalize the life of the population, ensure law and order , participate in countering sabotage and terrorist acts , and prevent a humanitarian catastrophe in the area of ​​the anti-terrorist operation.

Creation History

Conducting an anti-terrorist operation in the Donetsk and Lugansk regions revealed the existence of problems caused by the failure of local authorities to exercise their powers for a long time. In fact, they withdrew from the exercise of their powers. This extremely negatively affected the safety and livelihoods of the population in the area of ​​the ATO [1] .

After the relevant proposal of the National Security and Defense Council [2], the President of Ukraine Petro Poroshenko signed the Law of Ukraine "On Military Civil Administration" No. 141-VIII, adopted by the Verkhovna Rada on February 3, 2015 [3] . The Law applies to the period of the anti-terrorist operation and for six months after the day of its completion, but not more than three years from the date of its entry into force.

The goal of military civil administrations is to create the conditions for ensuring the vital functions of the respective territorial communities, to resolve local issues by establishing a special procedure for the exercise of certain powers of local self-government bodies ( rural , township , city ​​councils , their executive bodies, regional, district councils) in the anti-terrorist area operations when the relevant local authorities do not exercise such powers or self ranilis their implementation [4] .

Civil-Civil Administration Status

Civil-military administrations are formed, if necessary, by decision of the President of Ukraine. Civil military administrations of settlements are formed in one or several settlements ( villages , towns , cities ), in which village, town, city councils and / or their executive bodies do not exercise the powers vested in them. In the district , the region, civil-military administrations are formed in case of non-convening of a council session on time or to provide leadership in the field of public order and security.

Civil military administrations of settlements are formed from military personnel of military units, who are sent to them in the manner prescribed by law to perform tasks in the interests of defense of the state and its security, leaving them in the military service , serving in law enforcement agencies without exception from the list of personnel as well as employees who have concluded an employment contract with the Anti-Terrorism Center under the SBU.

The direct management of civil-military administrations is carried out by their heads. They are appointed and dismissed by the decision of the National Security and Defense Council of Ukraine .

Civil-military administrations exercise powers typical of local authorities, including delegated ones [5] . They exercise their rights in agreement with the ATC SBU [6] .

In accordance with Decrees of the President of Ukraine No. 123/2015 of March 5, 2015 [7] , No. 469/2015 of August 7, 2015 [8] , No. 472/2015 of August 13, 2015 [9] , No. 329/2016 of On August 11, 2016 [10] , No. 414/2016 of September 28, 2016 [11] , No. 513/2016 of November 19, 2016 [12] the following military civil administrations (CAA) were created:
