Directive 2006/116 / EC

Directive 2006/116 / EC of the European Parliament and of the Council of 12 December 2006 on the term of protection of copyright and certain related rights [1] is a set of provisions of the Directive on the harmonization of copyright term in the EU, including all amendments made up to and including 2006. The directive replaces the text of the previous Council Directive 93/98 / EC of October 29, 1993.

The Directive of the European Parliament and of the Council adopted on September 27, 2011 2011/77 / EC partially changes the provisions of Directive 2006/116 / EC on the terms of protection of copyrights and certain related rights. The replacement concerned the term of protection of a musical work of 70 years, it was specified for works recorded in the form of a phonogram - 50 years and non-phonograms - 70 years.

History

One of the important decisions that served as the basis for the adoption of Directive 2006/116 / EC on the harmonization of the protection of copyright and related rights was the decision of the EU Court in the case of “EMI v. Electrola. " In a court decision in this case, the Court expressed its fundamental point of view: an object of copyright that is not encumbered with a license of the owner of copyright can freely be distributed in another Member State only after the period of its legal protection in the state of distribution.

Prior to the publication of the Directive on Dates in the National Legislation of Member States, different states set different periods of validity for copyright. Directive 2006/116 / EC established the unification of such terms of protection, indicating that the work enjoys legal protection throughout the author's life and for 70 years after his death. according to the Directive, the validity period of copyright now begins to flow simultaneously in all Member States, from January 1 of the year following the date of creation or publication of the work.

Directive provisions

Directive 2006/116 / EC is a development of Directive 93/98 / EC on the term of protection of copyright and Directive 2001/29 / EC concerning the harmonization of certain aspects of copyright and related rights in the information society.

The directive establishes the rights of the author of a literary or artistic work for a period during the life of the author and 70 years after his death, regardless of the date when the work is published. The term for the protection of cinematographic or audiovisual works expires 70 years after the death of the last of the authors. The rights of producers of phonograms expire 50 years after the fixation of the work. Member States may protect scientific works that have entered the public domain by setting a maximum term of protection of 30 years from the date of publication.

Regarding the protection of photographs, they are protected for 70 years in accordance with Article 1 of the Directive. Moreover, the photograph must be original in the sense that it is the result of the intellectual creativity of the author.

The validity period does not apply to personal non-property rights.
