Burgenland Court District List

This is a list of jurisdictions located in the federal state of Burgenland . All existing jurisdictions, including former judicial districts, are listed.

History

In Hungary, the German-speaking population dominated in the committees (counties, counties, counties) Wieselburg (Moson) , Edenburg (Sopron) and Eisenburg (Wash) . Eisenstadt Land and District Courts

In contrast to the administrative-territorial division of the Austrian crown lands divided into districts ( German Bezirke ) and judicial districts ( German Gerichtsbezirke ), the Kingdom of Hungary ( German Königreich Ungarn ) was divided into committees (counties) ( German Komitate ) and estates ( German: Stuhlbezirke ). Therefore, in the German-speaking areas of this new state formation, it was also necessary to create a new administrative-territorial structure: political and judicial districts.

For Burgenland, in accordance with Section 48 of the Decree of the Federal Government ( German Bundesregierung ) of the Republic of Austria of July 22, 1921 No. 476, the Higher Regional Court of Vienna ( German Oberlandesgericht Wien ) became the court of the highest instance. Also in the territories allotted to Austria, simultaneously with the creation of the Land Court of Edenburg ( German Ödenburg ), in accordance with §49 of this judgment, judicial districts for civil and criminal justice were created. Formation of judicial districts

According to §49 of judgment No. 476 of July 22, 1921, the territorial jurisdiction of the Edenburg Regional Court included the district courts of Eisenstadt , Güssing , Ennersdorf , Mattersburg (until 1924 Mattersdorf) [2] , Neusiedl am See , Oberpullendorf , Oberwart and Edenburg. [one]

The jurisdictions of the Edenburg district court, as follows from this ruling, were subordinated to both the city of Edenburg (Sopron) and the surrounding rural areas of the political district of Edenburg, and the jurisdictions of the Eisenstadt district court to the free cities of Eisenstadt , Rust and the political district of Eisenstadt-Umgebung . The remaining jurisdictions coincided geographically with the newly created political districts. [one]

After the defeat in a referendum in Sopron ( German: Volksabstimmung in Ödenburg ), Austria had to cede Hungary to the city of Edenburg with an adjacent political district. [3] In this regard, Sopron could not be the center of the newly created political districts and district courts, nor could it be the administrative center of the newly created federal state. Also in this case, it was not possible for the prosecutor to carry out his accusatory and representative functions. Therefore, the functions of territorial jurisdiction in Burgenland from the Land Court of Edenburg were transferred to the Vienna Regional Court for Criminal Cases ( German Landesgericht für Strafsachen Wien ) and to the Vienna State Civil Court ( German German Landesgericht für Zivilrechtssachen Wien ).

Current situation

In Burgenland, a regional court - the Eisenstadt Regional Court was established on the basis of Federal Law No. 269 of December 2, 1958. The law entered into force on January 1, 1959 [7] . After its creation, the classification of other jurisdictions, however, remained unchanged. The merger of district courts, as in other federal states , was not necessary until January 1, 2018, when the merger of the district courts Ennersdorf and Güssing took place [8] .
