Bilateral copyright agreements with the USA

Bilateral copyright agreements with the United States are agreements between the United States and other countries that give American authors copyright protection in another country and authors from other countries to claim protection of their copyright in accordance with US copyright law .

Large US law

Agreements can take one of two forms with respect to the United States:

  • About swapping notes in accordance with US law under the laws:
    • International Copyright Law (March 3, 1891, 26 stat. 1106 )
    • Copyright Act 1909 (March 4, 1909, 35 stat. 1075 ), later Title Code 17 of the United States
    • Act of December 18, 1919 ( 41 stat. 368 ), which extended the completion of copyright in the United States to take into account the First World War ;
    • Act of September 25, 1941 ( 55 stat. 732 ), which extended the term for completing copyright in the United States to accommodate World War II ;
    • Copyright Act 1976 , which revised section 17 , in particular, 17 US p. 104 (b) (6)
    • Uruguay Round Agreements [1] ( Publ. L. 103-465 , 108 Stat. 4809 ), codified as 17 US S. 104A (d) , which deal with the restoration of copyright
  • Treaty ratified by the Senate of the United States of America and valid under the laws:
    • Copyright Act 1909
    • Copyright Act 1976 ( 17 US p. 104 (b) and 104A )

Treaties that deal only with copyright issues are commonly referred to as “conventions,” however, some other treaties (such as peace treaties) also contain copyright provisions.

It is difficult to give a final list of countries that have been affected in the table below. The succession requirements of states allow the de facto continuation of a treaty or agreement when their territory becomes independent . Thus, many laws continue to operate in the former dependent territories.

The U.S. Department of State is responsible for determining whether an agreement with this territory is still valid or not. For several former dependent territories, the issue of copyright has not yet been posed and the status of their copyright relations with the United States is indicated in the US Copyright Office as “undefined”. If the country continues to protect American copyrighted works from the time they gained independence, the agreement can still be considered valid: according to American law, the Secretary of State is responsible for resolving this issue. The President of the United States also has the opportunity to draft bills in accordance with 17 US S. 104A , recognizing copyrights for the country in question and providing copyright guarantees for those who work in the United States of America. This last option was used only once in relation to Vietnam. [3]

Validity of the 1976 Copyright Act

Agreements issued before January 1, 1978, on the date of entry into force of the 1976 Copyright Law , remain in force in accordance with Section 104 of this Law, which provides that: “all agreements issued by the President in accordance with Section 1 (e ) or 9 (B) of Section 17 as of December 31, 1977, or that are subject to the previous copyright law in the United States, shall remain in effect until terminated, suspended or revised by the President of the United States. ”
