Copyright in Afghanistan

Copyright in Afghanistan is governed by the Law of Copyright Supporting the Rights of Authors, Composers, Artists and Researchers (Copyright Law) of July 28, 2008, which refers to the support of the rights of authors, composers, artists and researchers [1 ] .

Content

International agreements

In 1958, Afghanistan ratified the Agreement on the Importation of Educational, Scientific and Cultural Materials (the Agreement on the Importation of Educational, Scientific and Cultural Materials ), with Annexes AE and the attached Protocol (Florence, June 17, 1950). In 1979, the UNESCO Convention on Measures to Prohibit and Prevent the Illicit Import, Export, and Transfer of Ownership of Cultural Property was adopted in Afghanistan . Cultural Property ) (Paris, November 14, 1970) and in 2005 ratified the Convention for the Protection of the World Cultural and Natural Heritage (Paris, November 16, 1972) [2] , and acceded to WIPO by the treaty of September 13, 2005, which entered into in effect at the end of 2005.

In November 2003, Copyright World magazine reported that a working group on intellectual property law was working to create a country's copyright system and was updating its trademark laws. This is a joint project of the Center for International Management of Education (CIME) and the American Bar Association of Asia's Legal Initiative (ABA-Asia) [3] .

US Relations

Since 2005, Afghanistan has not had an official relationship with the United States regarding copyright [4] , as a result of which works published in Afghanistan are not protected by copyright in the United States, and vice versa.

In October 2007, the US Department of Commerce and the Department of Commerce and Industry of Afghanistan signed a joint agreement to create a forum for commercial cooperation, including the protection and enforcement of intellectual property rights [5] .
