In 1998 - 2000 commanded the 160th Guards Tank Regiment, which took part in the Second Chechen War . In 2003, the North Caucasian District Military Court found guilty of abducting and killing 18-year-old [1] Chechen girl Elsa Kungaeva . He was sentenced to 10 years in prison. The investigation and the trial of Budanov had a great public outcry. He was released on parole in January 2009 . On June 10, 2011, he was shot dead in Moscow by a native of Chechnya, Yusup-Hadji Temirkhanov (who had previously been involved in the case as Magomed Suleimanov) [2] .

Biography

Born on November 24, 1963 in the city of Khartsyzsk (Donetsk region, Ukrainian SSR). In 1981, he was called up for military service in the USSR Armed Forces; he served in Poland. In 1987 he graduated from the Kharkov Guards Higher Tank Command School . He served in Hungary , Belarus and the Republic of Buryatia. It was noted that during the years of service Budanov had no penalties and, moreover, he received the rank of lieutenant colonel ahead of schedule. In 1995 - 1999 he studied at the Military Academy of Armored Forces. Marshal R. Ya. Malinovsky .

During the period of military operations against illegal armed groups in the Chechen Republic in January 1995, he suffered a brain concussion in an explosion of a land mine .

In August 1998 he was appointed commander of the 160th Guards Tank Regiment , in January 2000 Budanov was awarded the Order of Courage , at the same time the officer was promoted to the rank of colonel ahead of schedule [3] . In October and November 1999 Budanov was twice shell-shocked when a shell exploded and when a tank was fired from a grenade launcher.

On December 31, 1999, Budanov, despite a direct ban from his superiors, sent several tanks to help two companies of the 84th separate reconnaissance battalion, who were ambushed by militants near the village of Duba-Yurt. Scouts were saved. Budanov, according to him, was declared an official inconsistency for this. [4] [5]

The Budanov Case

Arrested on March 27, 2000 on charges of kidnapping, raping and murdering 18-year-old Elsa Kungaeva. The charge of rape after the examinations and testimonies of the participants in the case was dropped. [6]

On July 25, 2003, by the verdict of the North Caucasus District Military Court, Yuri Budanov was sentenced under paragraph “c” of part 2 of article 105 of the Criminal Code of the Russian Federation (“Murder”) to 9 years of imprisonment, in part 1 of article 126 of the Criminal Code of the Russian Federation (“Kidnapping”) to 6 years of imprisonment, according to paragraphs a, b of part 3 of article 286 of the Criminal Code of the Russian Federation (“Excess of official authority”) to 5 years of imprisonment with deprivation of the right to hold positions related to organizational and administrative functions in government bodies for a period of 3 years . The final punishment for the cumulative crimes committed by partial addition of punishments was determined in the form of imprisonment for a term of 10 years with serving a sentence in a maximum security penal colony and with deprivation of the right to hold posts related to organizational and administrative functions in state bodies for a period of 3 years. In accordance with article 48 of the Criminal Code of the Russian Federation, Yuri Budanov was deprived of the state award - the Order of Courage and the military rank “Colonel”.

Budanov was serving his sentence in the 11th detachment of correctional institution JI 78/3 in the city of Dimitrovgrad, Ulyanovsk Region.

In May 2004, Yuri Budanov filed a petition for clemency. On September 15, 2004, a pardon committee granted his request. The governor of the Ulyanovsk region Vladimir Shamanov signed a petition for clemency. The commission’s decision provoked protests from a number of politicians, human rights activists, and journalists. On September 21, 2004, a rally was held in Grozny , at which a protest was expressed against pardon. Ramzan Kadyrov said: "If this pardon of Budanov takes place, we will find an opportunity to pay him what he deserves." [7] [8] September 21, 2004 Budanov withdrew his request for clemency.

In November 2006, Budanov filed a petition for parole in a court of the Ulyanovsk Region; the request was refused. [9]

On December 24, 2008, the court granted Yuri Budanov’s request for parole . January 15, 2009 Budanov was released. [ten]

After Release

After his release, Budanov got a job as the head of a car fleet of the State Unitary Enterprise EVAZHD (for the operation of high-rise buildings). Budanov settled in the house of the Office of the President of the Russian Federation . This apartment was previously provided to his family with the assistance of General V.A. Shamanov . [eleven]

Threats from Ramzan Kadyrov

A number of media outlets drew attention to an interview with the head of the Chechen Republic Ramzan Kadyrov by the Regnum agency, in which, after the parole of Budanov, he gave him the following description [12] [13] : “Budanov is a schizophrenic and a murderer, a recognized enemy of the Chechen people. He insulted our people. Every man, woman and child believes that as long as Budanov exists, shame is not removed from us. ”

According to the observer of the newspaper Moskovsky Komsomolets , Vadim Rechkalov , Ramzan Kadyrov did not organize the subsequent murder of Budanov and did not incite him, “but with his public statements he issued political indulgence for the murder of the colonel” [14] . Izvestia and the Lenta.ru portal note that Ramzan Kadyrov sharply negatively accepted the offer to pardon the colonel in 2004: “ We will find an opportunity to give Budanov his due ” [15] .

Murder

On the afternoon of June 10, 2011, Yuri Dmitrievich Budanov was shot dead near the notary’s office in house No. 38/16 on Komsomolsky Prospekt in Moscow , where the Budanovs wanted to issue consent for their underage daughter Ekaterina to travel abroad [16] . The criminal fired six shots - four bullets hit Budanov in the head [17] . The killer and his accomplice fled in a silver Mitsubishi Lancer car, which, a quarter of an hour after the start of investigative operations, was found half-burned on Dovator Street , a few blocks from the crime scene. In the published video of the surveillance camera, which captures the last minutes of Budanov’s life, you can see the killer himself, but he never turned his face to the camera. The camera itself did not record the shooting of the ex-colonel, because the killer specifically chose the so-called blind zone for this. The car left by the killers turned out to be a false trace. According to her numbers, the detectives quickly found her owner and came to his house, where in the parking lot, much to their surprise, they found the exact same Mitsubishi. The machines matched all the characteristics and even the registration number. Most likely, the burned Mitsubishi was also once hijacked, and then the criminals at the base of the traffic police picked up an identical car in order to put the guards on a false track and gain time. It is also interesting how the killer shot. He used a special technique - firing twin shots or “deuces” (“double-tap” - from the English. “Double tap”). In other words, he very quickly pulled the trigger two times so that the bullets entered the victim’s body one after another. Budanov was killed from a gas pistol converted into a military one. Such weapons are much more difficult to calculate [18] . However, many experts doubt this version, and it has repeatedly been criticized for insolvency.

The authorities seriously feared that the murder of the former colonel could cause ethnic unrest, similar to those that took place in Moscow in December 2010, so they initially even spread the information that the car driver with the criminals was “a person of Slavic appearance” [19] , but these fears were not subsequently confirmed [20] .

On July 23, a message appeared on the Kavkaz-Center website in which the Riyadus-Salikhiin sabotage and terrorist group claimed responsibility for the murder of Budanov [21] , and Doku Umarov announced the involvement of Chechen fighters in the murder [22] . However, later reports indicated that in the video published the day after the murder, the gang leader said that “Allah of his own accord had a great holiday by giving Budanov” without indicating any involvement [23] .

Funeral

The funeral service for the former colonel of the Armed Forces of Russia, Yuri Budanov, took place in the Church of Saints Bessrebrenik and Miracle Workers Cosmas and Damian in Khimki . The closed coffin with the body of Budanov was taken out of the church and carried around her in his arms, then loaded into the hearse . The funeral took place at the central cemetery of Khimki [24] . More than a thousand people came to say goodbye to the deceased, including State Duma deputies, representatives of national-patriotic organizations, and war veterans. Despite the fact that by the verdict of the court Budanov was stripped of his rank and awards, they buried him with military honors . When the coffin was lowered into the ground, soldiers of the guard of honor from machine guns fired three salvos of mourning salute. [25]

Yu. Budanov was buried at the Novoluzhinsky cemetery in Khimki , near the memorial to Soviet pilots who died during the Great Patriotic War .

Investigation

From the very beginning, the Investigative Committee did not exclude the version of blood feud [26] , which could be carried out by immigrants from the North Caucasus [27] .

On August 30, 2011, on the suspicion of the murder of Budanov, the Islamic religious leader Magomed Suleymanov [28] was arrested, who later turned out to be a native of Chechnya, Yusup Temerkhanov [29] .

On July 6, 2012, the Main Investigative Directorate of the Investigative Committee in Moscow filed a final charge against Temirkhanov under paragraph "l" of part 2 of article 105 of the Criminal Code of the Russian Federation. According to this document, the accused killed the former colonel of the Russian army "on the grounds of political, ideological, racial, national or religious hatred or enmity or on the basis of hatred or enmity against any social group . " In addition, he was charged with illegal arms trafficking (Article 222 of the Criminal Code) [30] .

On April 29, 2013, the jury of the Moscow City Court found Temirkhanov guilty of the murder of Budanov. At the same time, jurors excluded from the verdict the motive “hatred of a group of military personnel”, which, according to the investigation, was guided by Temirkhanov.

On May 7, 2013, the verdict of the Moscow City Court sentenced Temirkhanov to. h. 1 tbsp. Art. 105 of the Criminal Code of the Russian Federation and part 1 of article 222 of the Criminal Code to 15 years in prison for the murder of Budanov and possession, carrying firearms from which Budanov was killed [31] [32] .

Subsequently, a criminal case was instituted on obstruction of justice in the framework of the trial of the murder of Budanov. It was found that jurors Vitaly Pronin, having entered into a criminal conspiracy with lawyer Musaev, together with jurors Falomeeva and Lomonosova, interfered with the administration of justice, persuading other jurors to make an acquittal decision. The case against Musaev, Part 1, Art. 294 of the Criminal Code (interference in any form in the activities of the court in order to prevent the administration of justice) was discontinued on February 18, 2015 due to the expiration of the statute of limitations for the crime, Diana Lomonosova was granted amnesty on April 24, 2015 in connection with the 70th anniversary of the Victory , Vitaly Pronin - May 5 [33] .

Yusup Temirkhanov, convicted of the murder of Budanov, died in prison on August 3, 2018.

On November 24, 2011, on the birthday of Yuri Budanov, a memorial plaque was erected in the courtyard of house 38/16 on Komsomolsky Prospekt , where a former colonel of the Russian army was shot dead. The words are engraved on black stone: “On June 10, 2011, Colonel Yuri Budanov was treacherously killed by the guard, who gave: life to the motherland, honor to nobody. The memorial stone was erected at the expense of those who honor and remember . ” [40]

The image of Yuri Budanov has been repeatedly used by opposition organizations and politicians in Russia. In particular, graffiti with the image of Yuri Budanov appeared in St. Petersburg in protest against the renaming of the bridge over the Duderhof Canal to the Akhmat Kadyrov Bridge [41] . Graffiti caused a widespread reaction in society and was vandalized [42] .
