OshTV

The OshTV television company was registered in the Osh City Council by an Osh businessman - Khudaiberdiev Khalilzhan ^[2] (Uzbek by nationality) as a small enterprise in March 1991 under the Soviet Union on the basis of the USSR Law “On the Press and Other Mass Media” ^[3] . Its production programs were aired on May 5, 1991. Initially, the channel broadcast leased airtime on the frequency of the First State Channel of Kyrgyzstan during its daily technical break (from 9 to 18 hours). After the collapse of the USSR and the publication of the Law “On Mass Media” of Kyrgyzstan in 1993, the OshTV television company received a mass media registration certificate number 055 dated April 7, 1993 from the Ministry of Justice. Since January 1995, the OshTV channel began broadcasting on its own 5-meter channel according to the frequency resolution of the State Communications Inspectorate of Kyrgyzstan (since 1997, the State Communications Agency under the Government of the Kyrgyz Republic) and brought the broadcast volume up to 20 hours a day. Broadcasting was conducted in Kyrgyz, Uzbek and Russian languages.

On August 22, 1998, the channel, in accordance with legislative changes, became OshTV Broadcasting Company LLC (founder - Khudaiberdiev Khalilzhan) and was re-registered as a media outlet in the Ministry of Justice of Kyrgyzstan on July 25, 2001 under number 562.

From January 1995 to March 2004, the broadcasting company broadcast on the 5 meter channel. Since March 2004, the channel has been broadcasting on the 23th DMV channel. During its existence, it has become the most popular channel in the south of Kyrgyzstan.

The great popularity of the channel, independence, influence on public opinion, as well as anti-Uzbek sentiment in Kyrgyzstan have become one of the reasons for pressure on the channel, employees and its leadership ^[4] .

During the pogroms in Osh in June 2010, the OshTV channel ^[5] was also damaged and was captured by the mayor of Osh, Myrzakmatov. After the events of June 2010, the television channel was forced to leave the leadership and all journalists, they were hiding fearing reprisals from the authorities and persecution by part of the population. Many have emigrated. After June 2010, the creative team was updated, broadcasting is only in the Kyrgyz language ^{[6] [7]} .

Thus, the channel had about 40 broadcasts of its own production, from 1991 to 2010, the staff grew from 3 to 50 people (including volunteers).

The first lawsuit arose in connection with the refusal to register OshTV in January 1991 by the State Radio and Television Committee of the Osh Region, after the trial, the channel was registered in March 1991.

On March 16, 1999, the state agency - the State Committee for Radio Frequencies decided to seize the frequency of the 5-meter channel and transfer to OshTV channel 23 without adequate compensation and preparation, which meant the actual closure of the channel. According to the claims of the TV channel, 4 lawsuits took place in the arbitration courts of the city of Bishkek (November 18, 2000, February 1, 2001, June 12, 2001, September 13, 2001) the lawsuit was finally satisfied by OshTV and the court left the television company on channel 5 .

Despite this, in March 2004, OshTV was forced to leave Channel 5 and switch to channel 23 of the UHF, where it is currently broadcasting.

After the bloody events of June 2010 in the south of Kyrgyzstan, Khudayberdiev Kh. Transferred 51% of the company’s shares to other individuals under threat ^[5] , while the founder and owner of the TV channel Khudayberdiev Kh. Was sentenced in absentia to 20 years with confiscation of property. According to journalistic organizations and Khudaiberdiev himself, the charges were fabricated ^[8] . Kh. Khudaiberdiev’s appeals to higher courts of Kyrgyzstan were not satisfied; his complaint to the UN Human Rights Committee is currently pending.

By a decision of the Osh Interdistrict Court of December 8, 2010, Khudayberdiev Kh. Was excluded from the list of founders and K. Koshbaev became the 100% owner, then on April 5, 2011 Koshbaev K. transferred all the shares to Abdykaparov A. (member of the Uluttar Birimdigi party.) Party leader is ).

By the decision of the Osh regional court of March 6, 2014, and then of the Osh interdistrict court of March 31, 2014, of the regional court of May 12, 2014, all agreements and court decisions made in relation to the channel were canceled from July 2, 2010 and 100% declared the owner of the channel H. Khudaiberdiev. Then, on the basis of the confiscation decision of the Jalal-Abad city court and subsequent courts in respect of Kh. Khudaiberdiev, the OshTV channel was nationalized by the decision of the State Property Committee of Kyrgyzstan of June 30, 2014 and is now a state channel ^[1] .

For the entire period of media research by Marketing-Info Company (2004-2005-2006-2007-2008-2009) in the nomination "Best Local Television" of the "Choice of the Southern Capital" campaign, OshTV Broadcasting Company ranks first by a large margin. The remaining places were distributed among 5 other shopping and entertainment centers in Osh ^[9] . Every year on May 5, in honor of the channel’s birthday, a holiday was held with the participation of more than 30 thousand residents and guests of Osh. The role of the channel in covering democratic processes in Kyrgyzstan was noted by the NEW YORK TIMES newspaper on March 30, 2005 in an article by Craig S. Smith ^[10] .
