Boer, Henry

Heinrich Boer (September 27, 1921 - December 1, 2013) is a war criminal, a member of the Waffen-SS . He was on the list of the most wanted Nazi criminals compiled by the center of Simon Wiesenthal .

The early years

Boer was born in the city of Eschweiler , located in Germany. His father was Dutch and his mother was German. When Buru was two years old, his parents moved to the Dutch city of Maastricht . In September 1940, shortly after Holland was occupied by the Third Reich, Boer voluntarily joined the Waffen-SS. In June 1941, he was sent to the Eastern Front, where Boer took part in military operations against the USSR [1] . In December 1942, Boer fell ill with pyelonephritis , and was recalled from the front back to Maastricht [2] .

War Crimes

In 1943, Boer joined the Sonderkommando Feldmeijer squad. There were 15 people in the detachment; it was formed on a voluntary basis. The task of the punitive detachment against members of the Dutch resistance and anti-German-minded residents of the Netherlands [3] .

During his service in the punitive detachment, Boer took part in the punitive operation “Silbertanne” , during which at least 54 people were killed, in the murder of 3 of them, Boer acknowledged his participation [4] .

Post-war years

After the war, Boer was arrested and spent 2 years in a prison camp. There, during interrogation, he admitted his involvement in three murders. After leaving the camp, Boer, fearing that he might be convicted and sentenced to a long prison term, fled to Germany . In 1949, a Dutch court in absentia sentenced Boer to death for three murders, helping the enemy and serving in the enemy army. According to the Dutch laws in force at that time, persons convicted of service in the enemy army automatically lost their Dutch citizenship. Boer, having fled to Germany, received German citizenship in accordance with the Führererlass, a law passed under Hitler, according to which all members of the SS were automatically granted German citizenship. In the 1950s and 1960s, this law was still in force; later, this law was repealed under pressure from the European Union. Germany refused to extradite Boer to the Netherlands; in West Germany, Boer has never been tried for war crimes [4] .

The Netherlands repeatedly demanded to extradite Boer, but in 1983 a court in Germany refused to extradite him, so at that time Boer was considered her citizen, and Germany did not extradite her citizens at that time. In 2007, the Aachen court ruled that Boer could serve his sentence in Germany, but the Cologne court, which was considering the appeal, quashed his decision, citing the fact that the decision of the Dutch court, which in 1949 found Buer guilty, is invalid, as he did not represent the defense of the Boer [4] .

On January 8, 2009, the Aachen court ruled that Boer should not be prosecuted due to his state of health [5] .

On July 7, 2009, the Higher Regional Court of Cologne, as a higher court, quashed the decision of the Aachen court [6] . The trial of the Boer began on October 28, 2009 in Aachen [7] .

In 2009, Boer lived in his house in Eschweiler [4] . During the trial of him, he was not arrested. In an interview with Der Spiegel magazine , Boer said: “I am not interested in what happened there” [8] . On March 23, 2010, the Aachen court sentenced Boer to life imprisonment [9] .

After rejecting Boer's appeal, Boer was jailed. This happened on December 16, 2011. At that time, Buru was 90 years old [10] . On December 1, 2013, Boer died in the prison of the city of Frendenberg ob Ruhr [11] .
