Constitution of Peru

The Constitution of Peru is the fundamental law of Peru . The current constitution, adopted on December 31, 1993, is the fifth in a row of the Constitution of Peru in the 20th century. She replaced the 1979 Constitution. [1] A draft constitution was created by the Democratic Constituent Congress , which was convened by President Alberto Fujimori during the 1992 Peruvian constitutional crisis following the dissolution of Congress . The draft new Constitution was promulgated on December 29, 1993. The Democratic Constituent Congress was re-elected in 1992, and the new Constitution was adopted in a referendum in 1993.

The current Constitution of Peru differs from the 1979 Constitution in that it gives the President more power than before. For example, it allowed re-elections, a bicameral Congress, consisting of 240 deputies, was reduced to a unicameral of 120, [2] and not only confirmed the President’s right to veto , which was also present in the previous constitution, but also gave him the right to use an article-by-article veto , as well as prescribed that all tax laws should be pre-approved by the Ministry of Economy and Finance . According to the 1979 Constitution, the President had the right to dissolve Congress after Congress did not approve the appearance of new Cabinet members 3 times, while the current Constitution allows the President to do the same after 2 disapproval. The constitution gives the President the ability to legislate while he is the first to inform Congress of his intention to do so. If the President dissolves Congress, the Constitution gives him the right to rule a country without Congress until the election of a new Congress, but for no longer than 4 months, during which time the Permanent Committee of the dissolved Congress will continue to function.

1979 Constitution

The 1979 Constitution was adopted on July 12, 1979 by the Constitutional Assembly , elected in June 1978, after 10 years of military dictatorship. She replaced the 1933 Constitution. The constitution came into force in 1980 after the re-election of ousted President Fernando Belaunde Terry . According to her, the president could be elected only for one term of 5 years. A bicameral legislature was established, consisting of the upper Senate (60 members) and the lower House of Deputies (180 members). Also, literacy testing has been removed from the Constitution as a condition for possessing suffrage . were allowed to participate in the election of persons over 18 years of age. [2]
