Biography
Marina Aleksandrovna Kalugina was born on October 8, 1962 in the city of Kurgan [3] .
In 1979 she graduated from secondary school No. 29 of the city of Kurgan.
In 1983 she graduated from the Biological and Chemical Faculty of the Kurgan Pedagogical Institute and went to work as an instructor in the Komsomol organizations department of the Kurgan Regional Committee of the Komsomol . Later, Marina Kalugina took the post of director of the House of Educators, and then - the chairman of the children's public association.
In 1996, she was appointed director of CJSC Romantika (children's sanatorium and recreation camp Romantika). She worked in this position until June 2002, when the SLCKD “Romantika” joined the newly created OGUP “Children Plus, the Association of Sanatorium-and-Health Camps of the year-round operation”, and Kalugin was appointed him the general director [4] .
In 2004 she graduated from graduate school and defended her thesis at Chelyabinsk State University . The scientific work of Marina Kalugina was devoted to the formation of the professional personality of the future teacher-educator. Marina Aleksandrovna Kalugina is the author of 17 publications on pedagogy.
Since November 2007, she is the head of the Kurgan regional branch of the Social Insurance Fund.
In October 2008, she was appointed to the post of Deputy Governor of the Kurgan region for social policy. The post of Deputy Governor for Social Policy was abolished in June 2007. However, during this time, the powers of the region in this area have expanded significantly, and therefore it became necessary to introduce it again [5] .
In 2011, the official earned 1.7 million rubles. According to the declaration published on the website of the Government of the Kurgan region, her property included a land plot of 700 square meters and a garden house. Over the same year, her husband earned 1.9 million rubles. He owned three apartments with an area of 109, 92 and 49.9 square meters, two trucks, a caravan and a parking space [6] .
From 2008 to 2011, according to the results of the competitions announced by the “Fund for Supporting Children in Difficult Life Situations”, 70 million rubles were allocated for the development of regional target programs: “Children of the Trans-Urals” for 2008-2012, ”“ A Childhood Free from Cruelty "For 2010-2012", "I can live independently" for 2011-2013 " [7] . Criminal Case
A criminal case was instituted at the end of 2011 on the theft of 6 million rubles from OGUP “Children plus”. The suspect was Igor Dmitrievich Potemkin, former Deputy Director for Economic Affairs of OGUP Deti Plus. In April 2012, Potemkin entered into a pre-trial agreement with the preliminary investigation authorities, so the criminal case against him was set aside in a separate proceeding. The accused fully admitted his guilt and compensated for the damage; in addition, he testified against his former head, director of the Children Plus OGUP Marina Kalugina and her husband Ivan Smolin, deputy director of the Children Plus OGUP.
On April 10, 2013, I.D. Potemkin, former Deputy Director for Economic Affairs of OGUP Deti Plus, was sentenced. For embezzlement of the organization’s money, the judge sentenced him to five years probation with a fine of 100 thousand rubles and a trial period of two years. The punishment turned out to be so lenient because Potemkin made a deal with the investigation, becoming the main witness for the prosecution in the Kalugina case.
The indictment of Marina Kalugina was filed on June 29, 2013 [11] .
According to investigators, from October 2007 to February 2011, M. Kalugin, at different times, held the post of General Director of OGUP Deti Plus, SOLKD Association, the manager of the Kurgan regional branch of the Social Insurance Fund of the Russian Federation and the Deputy Governor of the Kurgan Region for Social politics, more than once violated the law. With the help of her husband, Smolin I.A. and her friend I. Potemkin, who held senior positions in the OGUP, she stole more than 7 million rubles from a state-owned enterprise. To do this, through a businessman controlled for the needs of the organization "Children Plus" purchased products and various goods at inflated prices. At the same time, the difference that remained on the bank account of the individual entrepreneur became the income of the accused.
IP Shulgin (later Nazarov) was created in 2007 on the initiative of Igor Potemkin, Deputy Director of the Children Plus Plus Economic Affairs Unitary Enterprise. At the same time, Veronika Nazarova, Kalugina’s niece, practically did not participate in the work of IE. She wrote out a general power of attorney for actions on behalf of the director Igor Potemkin, and at that time she studied full-time at the Academy of Labor and Social Relations . Natalia Aleksandrovna Komashko, the acting director general of OGUP “Children plus, Association of SLCKD”, testified in court - she said that Igor Potemkin dealt with all financial issues in the OGUP and admitted that the company suffered 20% damage after changing the supplier to IP Nazarov. from the cost of food; as well as an accountant, Okhokhonina, who answered questions about the accounting activities of the enterprise. In addition, from February 2009 to February 2011, Kalugina, as the deputy governor, took part in the management of the commercial organization LLC Sanatorium-resort association “Children Plus” ( Nizhny Novgorod Region ). At the same time, she provided this company with various benefits and advantages that helped her to occupy a leading position in the market of spa services. For such beneficial protection, the organization paid the accused more than 1 million 700 thousand rubles in salary, and also paid for personal trips on trains and airplanes, having spent 500 thousand rubles on this.
On July 4, 2013 M.A. Kalugina was temporarily removed from her post by decision of the Kurgan City Court. She was assigned an allowance in the amount of the subsistence minimum established in the Russian Federation - 7275 rubles. 60 kopecks [13]
On August 27, 2013, the Kurgan Regional Court upheld the decision of the lower court to temporarily remove Marina Kalugina, vice-governor of the Trans-Urals, from the post. In their appeal, Kalugina and her counsel stated that the main argument of the investigation about the possible pressure from the accused on the witnesses is untenable. The main witness, the former assistant to the vice-governor Svetlana Koltysheva, no longer works in the regional government, so Marina Kalugina can not exert any pressure on her. The defense's arguments were not upheld. The decision of the Kurgan city court was changed only in terms of the amount of the monthly allowance, which should be paid to Marina Kalugina from the federal budget.
On March 5, 2014, in the Kurgan city court, the trial began on the case of charges of fraud in the dismissed vice-governor of Zauralie Marina Kalugina and her husband Ivan Smolin.
Potemkin spoke about the creation of the international center "Romance" in Cyprus . According to Interpol, the director of the company is the son of the accused - Alexey Kalugin [14] .
On September 19, 2014, M. A. Kalugin was found guilty of eight episodes of misappropriation or embezzlement under Part 3 of Art. 33, part 3, article 160, part 4, article 160 of the Criminal Code, in two abuses of official powers, provided for by part 3 of article 159 of the Criminal Code, as well as in illegal entrepreneurship, provided for by Article. 289 of the Criminal Code, and was sentenced to 5 years 6 months in prison and a fine of 530 thousand rubles. Smolin was found guilty of seven crimes under part 4 of article 160 of the Criminal Code of the Russian Federation (embezzlement of entrusted property using official position by an organized group on a particularly large scale), and part 3 of article 160 of the Criminal Code (embezzlement of entrusted property by a group of persons on a large scale) and sentenced to 5 years and a fine of 530 thousand rubles. The panel of judges in the person of Igor Golovin, Yuri Dyachenko and Alexander Ermokhin, after hearing the arguments of the defense and the charges, made a decision within an hour. The sentence changed the qualification attributes for a number of articles, but the punishment remained virtually unchanged. Marina Kalugina was sentenced to 5 years of imprisonment for 6 months in a penal colony of general regime, as well as a fine of 530 thousand rubles. The court sentenced spouse Ivan Smolin to 5 years of imprisonment and a fine of 530 thousand rubles. In addition, the accused is deprived of the opportunity to occupy leadership positions in government bodies for three years.
Kalugina and Smolin came to the pronouncement of the verdict, but after the break they disappeared and were put on the wanted list. The court’s video cameras recorded how Kalugina and her husband got into the car. In accordance with the current criminal law of the Russian Federation, for escaping from a place of deprivation of liberty, from arrest or from custody, a courtroom shall be deprived of liberty for a term of up to 4 years, in addition to the announced verdict.
On December 4, 2014, the Judicial Collegium for Criminal Matters of the Kurgan Regional Court examined the appeal against the verdict of the first instance court of the former deputy governor of the Kurgan region Marina Kalugina and her husband Ivan Smolin against the conviction of the trial court [15] . There were neither Kalugina nor Smolin in the hall of the Kurgan Regional Court. The interests of Marina Kalugina were represented by lawyer Vyacheslav Tyulenev, and Ivan Smolin was represented by lawyer Vladimir Vagin. Lawyers asked the criminal case board headed by Igor Golovin to acquit their clients, stating that “all the information in the case of Kalugina’s charge is of the nature of the assumptions”, “there is no documentary evidence that Smolin received the money”, “the court did not take into account the contradictions in the testimony of witnesses "," It was Potemkin’s testimony that became the basis of the charge, there is no other evidence, "" only Igor Potemkin was in charge of all financial matters at the OGUP. On April 14, 2015, in Nizhny Novgorod, Marina Kalugina and Ivan Smolin were detained by officers of the Ministry of Internal Affairs of Russia in the Kurgan Region together with officers of the Ministry of Internal Affairs of Russia in Nizhny Novgorod [18] . The investigators spotted Marina Kalugina near the apartment, which she rented with her husband in Nizhny Novgorod. Convicts were placed in the remand prison of the Federal Penitentiary Service of Russia in the Nizhny Novgorod Region. After that, they were transferred to jail No. 1 of the Kurgan region.
On April 27, 2015, the Kurgan City Court rejected the requests of the defenders of the convicts to prevent Kalugin and Smolin from being escorted to Zauralie. Reason: the stage can no longer be deployed [19] .
