Requirements for Presidential Candidates
To be elected as President of the Republic, a candidate must:
- have exclusively Algerian citizenship and origin;
- to be a Muslim;
- be at least 40 years old by the day of election;
- enjoy all civil and political freedoms;
- provide evidence that the candidate’s spouse is a citizen of Algeria;
- to confirm participation in the revolution on November 1, 1954 for candidates born before July 1942;
- confirm the non-participation of the parents of the candidate born after July 1942 in acts hostile to the revolution of November 1, 1954;
- submit a public declaration of his movable and immovable property in Algeria and beyond.
The president’s mandate is five years. The President of the Republic may be re-elected only once.
The President of the Republic takes the oath before the people in the presence of all the highest instances of the nation during the week following his election. He takes office upon taking the oath.
The President of the Republic swears the following oath:
| In the name of Allah, gracious and merciful, remembering the great sacrifices, the fallen heroes and values of the November Revolution, I swear to respect the Islamic religion, defend the Constitution, ensure the enduring nature of the state, work to ensure the necessary conditions for the normal functioning of institutions and the constitutional order, I will strive to strengthening the democratic process, respecting the freedom of choice of the people, ensuring compliance with laws and decisions of state bodies, maintaining territorial integrity the state and the unity of the people and the nation, to defend freedom and fundamental human and civil rights, fight tirelessly for the progress and prosperity of the people, for the attainment of the highest ideals of justice, freedom and peace in the world. |
Authority
President of Algeria:
- He is the supreme commander of all the armed forces of the Republic;
- He is the Minister of Defense;
- Defines and conducts the foreign policy of the country;
- Presides over the Council of Ministers;
- Appoints the head of government and terminates his authority;
- Signs presidential decrees;
- Has the right to pardon, postpone and commute punishment;
- Can appeal to the people through a referendum on any issue of national importance;
- Concludes and ratifies international treaties;
- Appoints: to the positions provided for by the Constitution; to civil and military posts in the state; to the positions established in the Council of Ministers; Chairman of the Council of State; Secretary General of the Government; Governor of the Bank of Algeria; judges; security managers;
- Cannot delegate authority to appoint the head of government and members of the government, as well as chairmen and members of constitutional institutions for which another form of appointment is not provided for by the Constitution;
- Declares a state of emergency in the country in the event of an immediate threat to state institutions, independence and territorial integrity;
- During the state of emergency, with the consent of the Supreme Security Council and after consultation with the President of the National People’s Assembly and the President of the Council of the Nation, announces general mobilization at a meeting of the Council of Ministers;
- Announces a state of war in the event of real or imminent threat of aggression at a meeting of the Council of Ministers, with the consent of the Supreme Security Council, after consultation with the chairman of the National People’s Assembly and the chairman of the Council of the Nation;
- Issues decrees issued by him for approval by each of the chambers of parliament during the next session;
- May require a second reading of the adopted law within 30 days after its adoption;
- May send a message to Parliament;
- Heads the Supreme Judicial Council of the country;
- Appoints the Chairman of the Constitutional Council for a term of 6 years;
- Convenes the Constitutional Council;
- May take the initiative to amend the Constitution;
- Introduces amendments to the Constitution;
- May delay the entry into force of laws adopted at the initiative of deputies until they are approved by the National Council.
