Electoral Barrier
In the previous European elections in Germany, a 5% electoral barrier was set for parties. However, in November 2011, the German Supreme Court ruled that such a high barrier is unconstitutional, as it discriminates against small parties. Although the court did not indicate an acceptable barrier, German lawmakers lowered the barrier for political parties to 3%. [1] However, on February 26, 2014, the Constitutional Court declared this election barrier unconstitutional. [2]
