In 1985, he graduated from Pansini High School.

July 10, 1990 received a diploma of higher education in the specialty " lawyer " at the University of Naples Frederick II .

Prosecutor and Judge

In 1993, he passed the exam for admission to the judiciary and became the judicial auditor in Naples, and since 1995 - the deputy prosecutor of the Republic at the court in Catanzaro .

In 1998, he returned to Naples and took the post of deputy prosecutor of the Republic at the court. In 2003-2008, he again served in Catanzaro. In 2008-2009, he again served in Naples as a judge of the Court of Appeal.

He has a reputation as an uncompromising fighter with camorra, an enemy of corrupt officials and criminals ^[1] .

His investigations often encountered political obstacles, and attempts were made to subject him to internal disciplinary measures. One of his investigations ( Inchiesta Why Not ) led to the resignation of Italian Minister of Justice Clemente Mastella , and in 2008 to the downfall of the center-left government led by Romano Prodi ^[2] .

On April 20, 2016, the judges of the 1st section of the Salerno court acquitted all six suspects in the case, in which De Magistris was charged with the fact that his investigations Why Not and Poseidon were based on the conspiracy of several law enforcement officials ^{[3 ]} .

MEP

In 2009, elected to the European Parliament . From July 16 to 19, 2009 - member of the Committee, and from July 20, 2009 to July 18, 2011 - Chairman of the European Parliament Budget Monitoring Committee. From September 16, 2009 to July 18, 2011 a member of the Delegation for Relations with the Middle East .

Naples Mayor

In the mayoral election of Naples, as a representative of the Italy Values anti-corruption party, he received support from 65% of the city’s active voters. Since May 30, 2011 he has been the mayor of Naples.

The mayor and his team managed to overcome landfills, and social programs were launched in the city to help the unemployed and elderly Neapolitans. It was possible to unload public clinics and hospitals, and in general to improve the state of healthcare in the city. Naples is being cleared of organized crime ^[1] .

During the first two years of rule in the city, several serious organized crime groups were eliminated. On May 24, 2011, Giuseppe Dell'Aquila, one of the 30 most dangerous criminals in Italy, was detained ^[1] .

At the end of 2012, he created the nationwide party “Orange Movement”, whose ideology is anti-mafia and leftist ^[1] . It was replaced by the political association “Democracy and Autonomy” ( Democrazia e Autonomia ), which in 2017 was transformed into an independent party and joined the coalition of the left “Free and Equal” ( Liberi e Uguali ).

His father, grandfather and great-grandfather were judicial officials.

Married to Maria Theresa Dolce ^[2] in 1998. The spouses have two sons (2000 and 2004 years of birth)
