In 1002, he supported the Duke Heinrich of Bavaria from the Saxon Dynasty in his dispute over the throne of Germany against the Margrave Eckard Meissen and the Duke German of Swabia . After the election of the Duke of Bavaria as King of Germany in June 1002, Heinrich von Schweinfurt had certain hopes for the title of Duke of Bavaria.

The new king Henry II, however, did not intend to transfer the duchy to the Margrave and announced that the Bavarians had the right to choose their own ruler. Considering himself deceived, Heinrich von Schweinfurt, together with his cousin Ernst Babenberg and the brother of King Bruno , rebelled.

Despite the help that the Polish prince Boleslav I the Brave provided to the rebels, King Henry II soon conquered the rebellion in Nordgau and Franconia, and Henry von Schweinfurt was taken into custody. After a short imprisonment in the Giebichenstein castle, Margrave Heinrich was pardoned in 1004 and most likely received his allod in the Schweinfurt area and Margrave back, but lost the counties located between them and giving his power a dangerous concentration.
