State Council of Cuba

The Council of State ( Spanish Consejo de Estado ) - according to the Constitution of 1976, is a body that acts on behalf of the legislature (National Assembly of People's Power) between the sessions of the latter. Decisions are taken by vote from a simple majority of its members.

The Commission consists of a chairman , secretary, first vice-chairman, five vice-chairmen and 27 additional members. The chairman , secretary, first vice chair, and five vice chairs are also members of the Council of Ministers.

Content

Constitutional powers of the State Council

Article 90 of the Constitution establishes the powers of the State Council:

  • Ensure special sessions of the National Assembly of People’s Power
  • Establish an election date for the periodic renewal of the National Assembly of People’s Power

Legislative authority

  • Issuing decrees laws
  • Implementation of legislative initiative
  • Ratifies and denounces international treaties
  • Confirms its rules

Supervisory powers of constitutionality and legality

  • Gives to existing laws, if necessary, a general interpretation and mandatory
  • On the suspension of the decisions of the Council of Ministers and the agreements and provisions of the local assembly of people's power that do not comply with the Constitution or the law, or when they affect the interests of other settlements or the whole country of the country

Appointment Powers and Rewards

  • Appoints and dismisses, at the suggestion of the President, the diplomatic representatives of Cuba in other states
  • Or refusal to recognize diplomatic representatives of other states
  • Appoint committees

Schools in exceptional states

  • Decree on general mobilization to protect the country in case of need to assume the authority to declare war in the event of aggression

Other powers

  • Other powers provided for by the Constitution and laws or granted to them by the National Assembly of People’s Power.
