Combat Organization of Russian Nationalists

The militant organization of Russian nationalists , known as BORN, is a group of right-wing radical Russian nationalists , also known as a neo-Nazi group [1] . Members of the group were charged with a series of murders and attempted murders. In 2011, one of the leaders and founders of the organization Nikita Tikhonov was sentenced to life imprisonment for the murder of lawyer Stanislav Markelov and journalist Anastasia Baburova , and his roommate Yevgenia Khasis received 18 years in prison. In April 2015, Maxim Baklagin and Vyacheslav Isaev were sentenced to life imprisonment, Mikhail Volkov was sentenced to 24 years in prison. In July 2015, the founder of the organization, Ilya Goryachev, was sentenced to life imprisonment for organizing a gang, five murders, and arms trafficking. The existence of BORN as an organized criminal group is called into question by the lawyers of the accused.

Activities

The goals of the community were crimes of an extremist nature and attacks on citizens - murders based on ideological and national hatred and enmity, attacks on the lives of law enforcement officers out of revenge for their legitimate activities, as well as other crimes.

According to the testimony of the BORN organizer and Tikhonov, he met Alexander Parinov, nicknamed “Romanians” in the late nineties, when they were part of the United Brigade 88 Nazi skinhead group, which was engaged in attacks on migrants and pogroms in markets in Yasenevo and Tsaritsyno . In 2005-2006, Tikhonov and Parinov participated in attacks on anti-fascists. On April 16, 2006, the company decided to attack visitors to the anti-fascist punk concert, Tikhonov and other accomplices beat Yegor Tomsky, who managed to escape, and Parinov attacked Alexander Ryukhin, who was killed with several stabs to the head and heart. After the arrest of several attackers, Parinov and Tikhonov were hiding. Tikhonov already planned to create an ultra-right combat organization [2] .

Tikhonov met Ilya Goryachev in 2002, the same year they went to Serbia, where they met supporters of the Orthodox monarchist Nebojša Krstic and were inspired by the ideas of pan-Slavism . Returning to Moscow, they begin to publish the Russian Image magazine [3] .

According to Lenta.ru, in 2007, Tikhonov was still hiding in Ukraine, but Goryachev invited him to return and engage in a joint political struggle. It was planned that Tikhonov would head the power wing of the organization, and Goryachev act in a legal field, in contact with officials. The name of the organization was chosen based on the name of the organization of the Social Revolutionaries . By 2008, the backbone of the organization also included the former FSB warrant officer Alexei Korshunov, whom Tikhonov was familiar with in his activities at OB-88 [3] .

Since 2008, the Combat Organization of Russian Nationalists has confirmed its existence with statements published after high-profile killings on right-wing websites. For a long time it was considered only a “brand”, which was used by some of the representatives of Russian nationalist movements for intimidation.

According to the investigation, the BORN participants were involved in the murders of Moscow City Judge Eduard Chuvashov , lawyer Stanislav Markelov , journalist Anastasia Baburova, leaders of the anti-fascist movements Fedor Filatov, Ilya Dzhaparidze and Ivan Khutorsky , world champion in Thai boxing Muslim One Rasul Abdull Halilov, Soso Khachikyan, Salokhitdin Azizov [4] , assassination attempts on citizen Ramazan Nurichuev and internal affairs officer Gagik Benyamyan [5] .

Alexey Korshunov, Mikhail Volkov, Maxim Baklagin, Vyacheslav Isaev and Yuri Tikhomirov [6] participated in the gang and in the attacks they carried out on the basis of the criminal case at different times from mid-2008 to March 2011, in addition to the creators of Goryachev and Tikhonov. Later, Yuri Tikhomirov was acquitted [7] .

In autumn 2008, Tikhonov, along with Mikhail Volkov, another former OB-88 member, committed the murder of anti-fascist Fedor Filatov [3] .

Later, in revenge for the murder of visitors to Uzbekistan by Anna Beshnova, the organization began to plan the murder of an accidental migrant. The victim was Salokhitdin Azizov, whom Parinov and Alexander Korshunov killed and cut off the head of a machete. The head was photographed to send the image to the editors [3] .

In the same year, the group according to the publication “Lenta.ru” was replenished by members of ultra-right groups from Dubna and Dmitrov near Moscow: Yuri Tikhomirov, Maxim Baklagin and Vyacheslav Isaev [3] .

In January 2009, Parinov once again went to Ukraine and did not participate in the affairs of the group [2] .

January 19, 2009 Tikhonov (after a conditional signal filed by Khasis) kills Stanislav Markelov and Anastasia Baburova [3] .

On June 28, 2009, the anti-fascist Ilya Dzhaparidze is killed [3] . September 3, 2009 - the murder of a member of the "Black Hawks" Rasul Halilov. November 16, 2009 - the murder of Ivan Khutorsky [3] . December 24, 2009 - the assassination of Thai boxing champion Muslim Abdullayev and the assassination attempt on his friend Ramazan Nurichuev. April 12, 2010 - the assassination of federal judge Eduard Chuvashov, who previously led the trial of nationalists from the White Wolves gang [3] . September 15, 2010 - the assassination of taxi driver Sos Khachikyan. March 2, 2011 - attempt on the district police officer Gagik Benyaminyan.

As of July 2015, one prospective member of the organization, Alexander Parinov, nicknamed Romanian, who, according to media reports, is hiding in Ukraine and seen in relations with the Ukrainian Azov regiment [8] [9], remains at large.

Investigation and trial

In 2011, the SKP of the Russian Federation charged with the murder of two natives of Moscow born in 1980 and 1985 - Nikita Tikhonov and his girlfriend Evgenia Khasis. The suspects were detained on November 3 and 4, 2009 [10] . The investigation sent a petition to the court for their arrest [11] [12] . On April 28, 2011, Tikhonov and Khasis were found guilty by the jury of the murder of Markelov and Baburova and not deserving of leniency [13] .

May 6, 2011 Tikhonov was sentenced to life imprisonment, Khasis was sentenced to 18 years in prison [14] . On January 29, 2015, the Supreme Court of the Russian Federation upheld both Nikita Tikhonov’s sentence of life imprisonment and an additional 18 years for the creation of BORN [15] .

On October 4, 2011 in the city of Zaporozhye (Ukraine), one of the leaders of the extremist community, Aleksey Korshunov, while on the wanted list, died as a result of an accidental explosion of his own grenade. Upon request for legal assistance by the Ukrainian competent authorities, a number of investigative actions were taken at the place of temporary residence of the deceased, where a passport of a Russian citizen in the name of Korshunov, several passports of Ukrainian citizens with a photo of Korshunov, 2 pistols of Tokarev's design (TT) and ammunition for them, a silencer and a starting pistol remade for firing live ammunition.

In May 2013 , another alleged BORN member, Mikhail Volkov, was detained in Ukraine , who is accused of banditry (Article 209 of the Criminal Code), participation in an extremist community (Article 282.1 of the Criminal Code), and arms trafficking (part 3 of Article 222 of the Criminal Code ), as well as murders in an organized group based on political, ideological, racial, national or religious hatred. In August 2013 , Mikhail Volkov was extradited to Russia. Within the framework of the BORN activity, Volkov is charged with participation in two murders - Fedor Filatov and Rasul Halilov [16] .

On May 8, 2013 , Ilya Goryachev was detained in Belgrade , which the Russian media reported on May 9 , while noting that the law enforcement bodies of the Russian Federation have no complaints against the Russian and were not put on the wanted list. On May 13, 2013, the Investigative Committee of Russia stated that Goryachev was detained at the request of the Russian side as part of an investigation into the BORN case. The charges are based on the testimony prisoners Nikita Tikhonov and Evgenia Khasis, who are serving long prison sentences for the murder of lawyer Stanislav Markelov and Anastasia Baburova. According to Tikhonov and Khasis, against whom Ilya Goryachev previously testified [17] , Goryachev was suspected of involvement in the murder of Stanislav Markelov, Fedor Filatov and Ilya Dzhaparidze, as well as Rasul Halilov and Salahedin Azizov [18] . According to the lawyer, the ICR’s request for Goryachev’s extradition was based on the charge of involvement in the murder of Judge Chuvashov, which was withdrawn on the day of his delivery to Russia [19] . On June 5, 2013 , the Belgrade Supreme Court agreed to the extradition of Ilya Goryachev to Russia, but on July 18, 2013 the Court of Appeal quashed this decision [20] , indicating violations during the trial, and returned the case for re-examination. The Supreme Court in the shortest possible time passed a decision similar to the first, despite the decision of the Court of Appeal [21] .

The BORN criminal case file says that BORN militants received the addresses of the antifa activists from Goryachev. According to Tikhonov, Goryachev personally handed him a disk with addresses, explaining that he had access to the bases of the Center for Combating Extremism of the Ministry of Internal Affairs of the Russian Federation. Evgenia Khasis in her testimony told that Goryachev had friends in this structure who provided addresses and photographs of the intended victims. Some of the images - for example, Fedor Filatov - were made in the police department, where the "antifa" periodically fell after street fights [22] .

A confrontation was held between Ilya Goryachev and Nikita Tikhonov in December 2013 . [23] The confrontation with the second witness Eugenia Khasis, which the defense sought by the court [24] , was held on July 24, 2014 [25] .

Goryachev calls the current charges revenge for refusing to be recruited, for refusing to testify in the Tikhonov case, as well as an attempt to obtain defamatory information about a number of politicians of federal significance with whom he collaborated as a leader of the Russian Image movement. In a letter written on May 24, 2013 in Belgrade Central Prison [26] , Ilya Goryachev reports that in the spring of 2010 he was abducted by officers of the UZKS of the 2nd service of the Federal Security Service of the Russian Federation in the city center in the presence of a dozen witnesses and was forced to give false testimonies, which later refused already being in Serbia .

Former Pussy Riot lawyers Mark Feigin and Nikolai Polozov, who decided to defend Ilya Goryachev , argued that the case brought against him was political in nature and their client did not commit crimes against him [27] . On May 29, 2013, in an interview with Slon magazine, Mark Feigin did not rule out that the Goryachev case could be related to the resignation of Vladislav Surkov . Moreover, the lawyer noted that in the case there is “a substantial background, not related to Goryachev himself, but related to some individuals who are not yet held criminally liable” [28] . Goryachev’s second lawyer, Nikolai Polozov, said that the only grounds for initiating proceedings and extradition of his client are the testimonies of the convict Nikita Tikhonov, which he gave while in the colony in Kharpe . The pressure on Tikhonov during his stay in the colony "Polar Owl" was also stated by the lawyers of Nikita Tikhonov, Alexander Vasiliev and Alexei Pershin, saying that he was broken and intimidated [29] . Polozov gave an example of the scandal with the Polar Owl colony in Kharpe, where, according to Novaya Gazeta, testimonies were thrown out of life-sentenced prisoners [30] . In August 2014 , an employee of the Polar Owl, FSIN lieutenant colonel Yuri Sandrkin, was sentenced to 3.5 years in a penal colony and was found guilty of using force to force prisoners to write confessions, including in high-profile cases [ 31] . However, this information is not confirmed in any way.

On January 19, 2014, Goryachev was transferred from the Lefortovo pre-trial detention center to the Butyrsky detention center , and on the night of January 21-22 he was sent to the cell. As a result, Ilya opened his veins [32] [33] [34] . According to lawyer Mark Feigin, his client’s case is falling apart due to the lack of evidence of guilt, so the investigation is trying to intimidate Goryachev [35] [36] . After the incident, an internal audit was appointed in the Butyrsky pre-trial detention center, during which no offenses were revealed.

On September 24, 2014 , the Moscow City Court sentenced BORN organizer Nikita Tikhonov, accused of a number of nationalist crimes, to 18 years in prison, charged with six murders, two attempted murders and illegal possession of weapons. For the murder of lawyer Stanislav Markelov and journalist Anastasia Baburova, Tikhonov was already sentenced to life imprisonment. The trial took place in two days, without examining the evidence and questioning the witnesses, since Tikhonov fully pleaded guilty and concluded a cooperation deal with the investigation [37] .

On November 20, 2014, during her interrogation as a witness in the BORN case, Yevgeny Khasis announced that Ilya Goryachev had a curator Leonid Simunin (currently an adviser to the Ministry of Energy of the self - proclaimed Donetsk People’s Republic [38] [39] ), which at the end of 2000– He allegedly served in the internal political department of the presidential administration and was the representative of the head of this body, Vladislav Surkov [38] [39] [40] [41] , and financed his ward with funds aimed at youth policy. Goryachev turned to Simunin with a request to allow the creation of a legal ultra-right party, but he refused. Then it was decided to create a radical organization to incite conflicts in society and blackmail the authorities with resonant reprisals [41] . Khasis listed her famous murders: Filatov, Azizov, Markelov, Baburova, Dzhaparidze, Halilov, Khutorsky. According to her, Simunin asked Goryachev to kill an FSB officer and offered a monetary reward for this, but Tikhonov refused this offer, explaining that he was not a contract killer, but a revolutionary. In autumn 2009, Goryachev decided to kill "some representative of the judiciary." Tikhonov at the same time set forth a different version of his acquaintance with Simunin. According to him, he offered Tikhonov a job as a security guard and have a physical effect on debtors. According to an anonymous interlocutor of RBC’s publication in the AP, Simunin never worked in the presidential administration, but led the Lyubertsy cell of the pro-Kremlin Local movement [38] , and Goryachev also adhered to the same version [41] . According to Khasis, Goryachev was the ideological organizer of the gang, and Tikhonov was the technical one. Khasis said that BORN was the power block of the “Russian image” and compared organizations with the IRA and Sinn Fein. But Nikita Tikhonov disagrees with the testimonies of Khasis and Goryachev, who considers himself to be the only ideological leader of the BORN and claims that he was not the technical organizer, but Goryachev [40] [42] .

Nikita Tikhonov said at the court that hand-to-hand combat training for group members took place on the lands of businessman German Sterligov [43] .

On December 22, 2014 , at the request of the defense, Ilya Goryachev acted as a witness at a meeting of the Moscow Regional Court in the BORN case. During the interrogation, Goryachev said that he was not familiar with any of the accused, except Nikita Tikhonov, he also said that he had learned about the existence of BORN only during the night interrogation from April 20 to 21 from the head of the 3rd department of the UZKS FSB Colonel Viktor Shamenkov [44] [45] . Ilya Goryachev stated that he had never transferred the money, directions or other information necessary for conducting criminal activity to Nikita Tikhonov, who was convicted in September 2014 of organizing an extremist community of BORN [37] .

On April 21, 2015, the Moscow Regional Court sentenced Maxim Baklagin and Vyacheslav Isaev to the BORN case for life in prison, while Mikhail Volkov received 24 years in prison. Yuri Tikhomirov was acquitted, as requested by the state prosecution [46] [47] . At the end of March 2015, the jury found three persons involved in the case guilty of attempted murders and murders, including the Moscow City Judge Eduard Chuvashov. 24 июля 2015 года Илья Горячев был приговорен к пожизненному заключению [51] .
