Biography
The son of a senior gymnasium teacher in Mitawa [3] . From a German-speaking family. The younger brother of the scientist August Engelman . In 1855, he graduated with honors from the Law Faculty of St. Petersburg University . In 1859, right here, in Petersburg, he defended his master's thesis on civil law on the topic “On the acquisition of land ownership under Russian law”. September 25, 1859 the dissertation was awarded the Malaya Uvarov Prize of the Russian Academy of Sciences [1] .
After receiving his master's degree, he worked for 40 years as a professor in the Russian department, and then civil law at the Faculty of Law of the University of Dorpat . Repeatedly held the position of dean . Since 1900, retired. The sphere of scientific interests of Engelman were the problems of civil law, as well as the theory and history of Russian law.
In the field of civil law, he published a number of works that made a significant contribution to the development of Russian civil law and attracted contemporaries [4] . These are, in particular, the publications: “A systematic presentation of civil laws contained in the Pskov judicial decree” (St. Petersburg 1855, thesis), “On the statute of limitations on Russian civil law” (St. Petersburg 1868, another Small Uvarov Prize), “Textbook of Russian civil legal proceedings "(Yuriev, 1899), a number of articles in leading legal journals. These works are characterized by a wide knowledge of the author of the sources of law, their thorough and accurate analysis, reasonable criticism of their scientific opponents and existing judicial practice.
Even more significant is Engelman’s merit in promoting Russian law, its most important laws, in European countries. For many years he collaborated in the German edition of Centralblatt für Rechtswissenschaft, in which he regularly introduced the German reader to Russian legal literature. In addition, he published a number of works on the history of Russian law in German, in which he set out the basics of Russian legislation, described state institutions of Russia, in particular: "Peter der Grosse, seine Jugend und das Wesen seiner Reformen" (Dorpat, 1872), “Entstehung und Aufhebung der Leibeigenschaft in Russland” (1880–1881), “Das Staatsrecht des Kaisertums Russland” (Freiburg 1889), “Der Civilprocess, das Konkursrecht die Erbschaftsregulierung and die Konsulargerichtsbarkeit in Russland,”, ”,”, ”,”, ”,”, ”,”, ”,”, ”,”, ”,”, ”,”, ”,”, ”,”, ”,”, ”,”, ”,”, ””, ”
In the publication “Das Staatsrecht des Kaisserthums Russland” he described the main stages of the history of the formation and development of the Russian state, as well as the features of the organization of management in certain regions of Russia.
I. E. Engelman was a consistent supporter of the historical school of law and therefore distinguished the law reproduced by popular sense of justice from the law adopted by the state and saw the main task of Russian jurists in the maximum possible convergence of positive legislation and popular law. Contrary to the views of Russian jurists who recognized the decisive impact of foreign legislation on Russian law, I. Ye. Engelman saw in the system of Russian law an independent phenomenon of the Russian people, its distinctive spirit, justified the necessity and possibility of a separate study of Russian legislation and law.
