U.S. Court of Appeals for the Federal District

The United States Court of Appeals for the Federal Circuit , abbreviated as Fed. Cir. Or CAFC, is a federal court of appeal that examines certain categories of cases in which US federal authorities act as a defendant. He is the assignee of the US Court of Appeals for Customs and Patents and the US Claims Court; created in 1982 and consists of 12 judges.

The court is located in the Howard Markey National Courthouse in Washington , DC. Since the jurisdiction of the court extends throughout the country, its meetings can take place in addition to Washington anywhere else.

Jurisdiction

The Federal District Court of Appeals is unique among all U.S. courts of appeal, as it is the only court that has exclusive substantive jurisdiction based on a specific category of cases, and not on a geographical basis like everyone else. Court decisions, in particular with respect to patent cases, are unique in that they are a mandatory precedent throughout the United States under the subject jurisdiction of the court. However, the decisions of other courts of appeal are limited by their geographical location and, therefore, can create different judicial standards depending on location.

The U.S. Supreme Court can only verify and review a decision of the Court of Appeal if it substantially violates established jurisprudence or if there is an unresolved conflict of interest in federal law.

The Court of Appeal for the Federal District appeals final decisions taken on issues related to federal jurisdiction of the following specialized courts, government bodies, and federal institutions:

  • United States Federal Claims Court
  • United States Veterans Court of Appeals
  • Committee for the consideration of disputes and appeals in connection with the registration of trademarks ( English TTAB )
  • Chamber for Patent Complaints and Conflicts ( English BPAI )
  • US Armed Forces Board of Appeals for Contracts ( English ASBCA )
  • US Civilian Appeals Board for Government Contracts Appeals ( English CBCA )
  • U.S. Postal Contract Complaints Board
  • Council for the Protection of the Merit System (public service issues; Eng. MSPB )
  • United States International Trade Commission ( English ITC )
  • US International Trade Court
  • US Department of Labor Rights Compliance Office

He also exclusively considers appeals against decisions of US federal district courts that relate to:

  • patent cases, including appealing against decisions of the Commissioner for Patents and Trademarks;
  • claims to the federal government with a claim price of less than $ 10,000 (the so-called Small Act of Tucker );
  • issues related to the operation of the Act on Economic Stabilization of 1970 (regulates pricing);
  • action of the Extraordinary Law on the Distribution of Oil Reserves of 1973 (adopted to regulate oil prices during the crisis);
  • Act of the Law on Energy Policy and Energy Conservation of 1975 ;
  • Act of the Natural Gas Utilization Act 1978.
