The Namibian Constitution was adopted at a meeting of the National Assembly on November 9, 1990 . The Constitution of Namibia proclaims a sovereign , democratic and united state, built on the principles of democracy , respect for the law , and justice ( Eng. “The Republic of Namibia is hereby established as a sovereign, secular, democratic and unitary State founded upon the principles of democracy, the rule of law and justice for all " ) [1]

The Namibian Constitution adheres to the classical division of government into: legislative , executive and judicial [2] .
According to the Constitution, the head of state is the President [3] . The legislative body is a bicameral parliament: the upper house is the National Council of Namibia , the lower is the National Assembly of Namibia . Judicial power belongs to the Supreme Court , the High Court and lower courts (provincial). All judicial institutions are independent and subject only to the Namibian Constitution and its laws.
The Constitution consists of a preamble and 21 chapters (Chapter) , divided into 148 articles [4] .
Amendments
Amendments to the Constitution are adopted by two-thirds of the votes of the total number of members of each of the chambers of parliament. The president, in turn, can raise the issue of constitutional amendments for a national referendum. It is worth noting that the Constitution prohibits the introduction of any amendments to Chapter 3, which enshrines the basic guaranteed rights and freedoms if such amendments substantially reduce or underestimate them [5] .
