Biography
Dmitry Vinogradov was born on August 20, 1983 [10] in Moscow , where his parents had recently moved from Murmansk. Father - Andrey Vinogradov, a geophysicist, PhD, met his future wife, Elena, in 1978 in Sevastopol [3] [11] .
Dmitry was born with a strong oxygen deprivation , doctors diagnosed encephalopathy in a newborn as a result of birth trauma, as well as displacement of the vertebrae of the cervical spine [3] [11] . After a long course of massage in the clinic, the child was able to take the first steps, soon the parents returned to Murmansk, where Andrei Vinogradov participated in the study of the seabed as part of the expedition [3] .
The child grew shy and closed, did not attend kindergarten. At the age of two, he was diagnosed with autism [12] . At the age of four, on a walk, Dmitry received a serious head injury , after which he suffered headaches for many years [4] [11] .
In 1989, the Vinogradov family finally moved to Moscow and settled in an apartment on Kantemirovskaya Street , and Dmitry went to the first class of the 981st secondary school [11] . According to the memoirs of Elena Vinogradova, in the first grade the son could not answer at the blackboard - he was embarrassed, confused the words or was completely silent, risking remaining for the second year. At the request of the mother, the teacher began to ask the boy homework separately, after the lessons, his performance improved [3] [11] .
In high school, Dmitry was assigned to the humanities class. The teenager also attended wushu and tennis sections, but remained secluded, maintaining friendly relations with only some classmates [3] . According to his class teacher Lyudmila Yartseva, Vinogradov was always ready for lessons, even if he missed them, and wrote “simply amazing compositions” [13] .
In the 9th grade, Vinogradov went to school at the Moscow State Economic and Linguistic Institute (since 2009 - the Moscow Humanitarian and Technical Academy ). In 2000, he entered the Academic Law University on the basis of the Institute of State and Law at the Russian Academy of Sciences [3] . At about the third year of studies, Dmitry stopped attending classes, but at the same time he continued to independently study subjects of interest to him. At the same time, he enrolled in programming courses at Moscow's N. E. Bauman State Technical University [11] .
On the advice of teachers, Dmitry continued his studies, but transferred to the correspondence department. In 2009, he graduated from the Faculty of Law and received a master's degree in the department of civil law disciplines [3] [11] .
He began his career in 2004, settling in Corusconsulting LLC, where he worked for three months. The work seemed difficult to Vinogradov, and he moved to the MediaRight company as a system administrator [3] . In 2008, he joined the Rigla pharmaceutical company ( Protek group of companies [14] ), where he successfully passed an interview, psychological and legal tests, after which he was appointed as an associate lawyer. A year later, Dmitry was promoted to a lawyer, his duties included the legal execution of contracts. At work, he was characterized positively as a “tactful and polite person” [15] .
At the end of January - early February 2008, Vinogradov, as a volunteer, came to the camp of the “ World Wildlife Fund ” to help the birds affected by the oil spill in the Kerch Strait for 12 days [11] [16] .
Killings
Motives
The daily behavior of Vinogradov during the four years of his work at Rigla LLC did not cause his leadership and colleagues to be suspicious of inadequacy. Dmitry, according to colleagues, did not express any radical ideas and did not share his own problems with them [17] .
In the office, Vinogradov met a 26-year-old employee of the finance department, Anna Kaznikova, with whom he lasted for some time [11] [14] [17] [18] [19] . By the time she met, she had already met with her fiancé for several years already, who at Anna’s place of residence was already perceived as her actual husband [4] [20] . Dmitriy made Kaznikova gifts, took them to the cinema, together they made a trip to Suzdal, where they had first intimacy, but Vinogradov could not have sexual intercourse “because of psychological agitation” [2] , after which, according to him, their relationship they became cold, and the meetings did not go the way he wanted [2] [3] . Also, the young man was jealous of Anna to her colleague - Alexander Biryuk [11] . In January 2012, shortly before the planned joint trip to Edinburgh , Vinogradov and Kaznikova, they quarreled, after which the girl began to receive emails and threatening SMS from the young man [11] [19] .
After the break with Kaznikova, Vinogradov became depressed [11] [12] . After consulting with his mother, he visited No. 1 Alekseev Moscow Psychiatric Hospital No. 1 . He was prescribed three drugs - citroleps, finlepsin and serdolekt, and he was also offered to undergo therapy in a day psychiatric hospital. After that, Dmitry visited the hospital 4 more times, but the doctors did not convince him to undergo treatment [3] . According to the head of the department of socio-demographic and economic problems of psychiatry of the Scientific and Pedagogical Center of the Russian Academy of Medical Sciences Tatyana Salokhina, later Vinogradov addressed other specialists and underwent a medical examination [3] .
The motive of the attack, according to the investigators, could be in unrequited love, which Vinogradov himself told during interrogations and in court [5] . Also, according to him, he wanted to assert himself and show himself in front of Kaznikova [2] [21] .
Dmitry long and carefully prepared for the massacre of his colleagues [22] , he began to be interested in weapons soon after the break with Anna Kaznikova. In March 2012, Vinogradov acquired the Vepr-12 Hammer carbine and a Benelli M3 Super 90 rifle. He bought a carabiner at the Kolchuga store on Varvarka for 77,055 rubles, and a few days later went to the “Hunter” on 7th Parkovaya Street for a gun, on which he spent 34,750 rubles. Separately from weapons, he purchased more than 300 rounds [23] . Earlier, he issued a medical certificate at the clinic of Medservice LLC, which in February allowed him to obtain permission to acquire, store and carry weapons in the OMVD of Russia in the Nagatino-Sadovniki district of Moscow [11] [24] . Later, a version appeared in the media that a certificate to Dmitry in Medservice was issued for 900 rubles, bypassing the medical examination [25] . After buying a weapon, Vinogradov enrolled in a shooting club in Podolsk , repeatedly visited the shooting range [26] [27] .
A few days before the incident, the usually non-drinker Vinogradov stopped taking the antidepressants prescribed for him and went into the binge, which lasted about five days [4] [28] . Subsequently, he said that he did not intend to shoot at someone in advance and did not plan the date of the shooting, having made a final decision only on the evening of November 6 [3] .
The course of events
November 7 at 4:56 Moscow time (UTC + 4) Vinogradov posted on his page on the social network VKontakte a document called “My manifesto” in which he declared his hatred of humanity [4] [11] [29] :
I am sure that I have sufficient grounds to consider all of humanity a macro analogue of a cancer of a living organism; in the role of the latter in this case is our planet. <...> I hate human society and I hate to be part of it! I hate the meaninglessness of human life! I hate this life itself! I see only one way to justify it: to destroy as many particles of human compost as possible.
Mother Vinogradov said that he had taken time off and was going to the shooting range. Packing 12- caliber weapons and hunting cartridges for smooth-bore weapons of the Italian company Fiocchi Munizioni marking 12/70 [30] in a large backpack, he left the house, got into the Toyota brand's father’s car and went to work [11] . Before arriving at the office on Chermyanskaya Street , he parked in the next Tikhomirov street , slept a bit, and then went on foot inside the building [3] .
At 8:19, Dmitry passed the guard post at the entrance and the inoperative frame of the metal detector. At 8:20, he entered the toilet, where he changed into dark camouflage and a vest-unloading. In the pockets of the vest were more than 230 rounds and a large knife. He also called Kaznikova and, after making sure that she was at work in office number 400 on the fourth floor, went there [31] . At 9:49 Vinogradov, openly holding a weapon in his hands, left the toilet [3] .
On the stairs, Vinogradov encountered 33-year-old Denis Moiseyev, who had come for an interview on the advice of his wife working in Rigla. Shooting Moses in the head, he went on. At 9:50, the shooter entered office number 400. After welcoming the finance department staff there with the words “Hello, colleagues!” [32] , he opened fire on them (the version was originally expressed that Vinogradov shot from two hands [3] , but later it was not confirmed [11] [33] ).
Shooting lasted 18 seconds [14] . After ten shots, Vinogradov ran out of ammunition, and during reloading Nikita Strelnikov, 29, a seriously wounded 29-year-old, and then Yury Marchenko, a leading specialist in the financial and economic department, tried to stop him. [35] The gunner was neutralized by the company's security officers, Sergey Novikov and Vladimir Bagdasaryan, who came to the rescue. Vinogradov was disarmed and tied up with scotch tape, and soon transferred to the police [4] [26] [35] [36] .
As a result of shooting in the office, four people (25-year-old Elena Lapshina, 25-year-old Natalya Plekhanova, 42-year-old Alexander Biryuk and 33-year-old Anton Tretyakov [37] ) died on the spot, 24-year-old Yaroslava Sergenyuk and Nikita Strelnikov were hospitalized in severe condition [19] , the latter died the next morning [17] [34] [38] . On November 7, Vinogradov killed 6 people in total, of which he was personally acquainted only with Biryuk [2] . Anna Kaznikova was also at the moment at the crime scene, but Dmitry did not shoot her [19] .
Shortly after what happened in the media, Vinogradov was dubbed the “Russian Breivik .” The Norwegian terrorist, before organizing an explosion in the center of Oslo and an attack on the youth camp of the Norwegian Workers' Party, also laid out a manifesto of 1,500 pages, in which he expressed his ideological views [3] . Later Vinogradov said that he was not a follower of Breivik, because he had different motives with the Norwegian, and his manifesto, which as of November 8, 2012 had collected more than 5,000, and by December 27, more than 30 thousand marks “I like” [39 ] , called "stupidity" [40] .
Investigation
On November 8, 2012, Vinogradov was taken to the Babushkinsky District Court of Moscow. He was charged with the crimes provided for by paragraph “a” of part 2 of article 105 (“premeditated murder of two or more persons”) and part 3 of article 30 (“attempted murder of two or more persons”) of the Criminal Code of the Russian Federation [19 ] [22] . With regard to the shooter, a preventive measure was chosen in the form of detention for two months [41] . Vinogradov himself in court stated that he repented and offered condolences to the families and friends of his victims. At the same time, he added that if he had not been stopped, he would have continued to kill, and then he would have shot himself [5] .
On November 12, the Moscow City Prosecutor's Office on behalf of the Prosecutor General's Office of the Russian Federation appealed to Roskomnadzor with a request to limit access to Dmitry Vinogradov’s page on the VKontakte network [42] [43] . The reason for the prosecutor’s response was the placement by Vinogradov of his manifesto, which was later added to the criminal case [22] , as well as a number of photographs, in particular, the image of a target and a negro with a gun, signed with the slogan “End racism, kill everyone” ( rus. “End racism, kill everyone” ) [4] . The experts conducted a psychological-linguistic study of the text of the manifesto, which resulted in the establishment of: “the appeals contained in the text are aimed at the mass destruction of humanity and justification of such actions, that is, calls for terrorism” [44] .
Psychiatrists had to find out the degree of Vinogradov's responsibility, he was assigned a forensic psychiatric examination . In February 2013, the findings of the experts of the V. Serbsky State Research Center for Social and Forensic Psychiatry (State Scientific Center for Social and Applied Psychology and Social Development) [45] were published. It was established that at the time the crime was committed, the shooter suffered a schizotypal personality disorder [46] , which limited his ability to fully understand the actual nature and social danger of his actions and direct them, but this fact does not exclude his responsibility [47] .
On February 6, 2013, the Babushkinsky Court extended the arrest of Vinogradov for another two months [48] . On April 4, he was left in jail until May 7. The shooter did not object to such a decision, but asked to transfer from SIZO No. 2 “Butyrka” to SIZO No. 4, since there is a psychiatric hospital there. Vinogradov had previously been hospitalized there with a diagnosis of dysthymia . The investigation provided the court with a certificate from SIZO No. 4, according to which he could be kept in the detention facility, and his state of health was satisfactory, the prosecution agreed with these arguments [49] . After hearing the arguments of the parties, the court refused to transfer Vinogradov to another detention facility [50] .
On April 22, 2013, final accusation was brought against Vinogradov [51] . To the points already present, a charge was added for a crime provided for in part 1 of article 280 of the Criminal Code (“public calls for extremist activity”) [52] .
On April 30, 2013, the Ostankinsky District Court of Moscow fully satisfied the requirements of the prosecutor of the Northeastern Administrative District for the recognition of this Internet page with the publication on it as extremist. It was listed on the federal list of extremist materials [53] , and access to it was blocked [54] .
On May 6, the shooter again extended the arrest, this time until July 6 [55] . On June 11, the court left Vinogradov in custody until August 6 [56] .
In early June, the Investigation Committee of the Russian Federation reported that the investigation of the criminal case of Vinogradov was completed [57] and all materials were handed over to the prosecutor’s office for the confirmation of the indictment [58] . On July 24, the case was submitted to the Moscow City Court [59] .
Court
On August 5, 2013, the Moscow City Court closedly held preliminary hearings on the case of Vinogradov. The shooter filed a motion to consider the case by a professional judge, and not by the jury [60] . On August 14, consideration of the merits of the case began [61] .
On August 15, during the interrogation of Anna Kaznikova, who spoke as a witness, Vinogradov began to behave inadequately, beat his fists at the bulletproof glass of the “aquarium” cell, which during court sessions contained accused of committing grave and especially grave crimes, and then turned to convoy asking to shoot him. The reason for this reaction from Vinogradov was the personal questions that his lawyer began to ask Kaznikova. The judge managed to reassure the accused, after which he asked Kaznikova whether she wanted to be shot. The witness replied in the negative, and the judge explained to Vinogradov that the death penalty has not been applied in Russia since 1997 [18] [62] . The court also interrogated the injured during the shooting of Yaroslav Sergenyuk and Yuri Marchenko, who neutralized the shooter [32] .
On August 27, the relatives of the two office workers killed by Vinogradov demanded moral damages in the amount of 3.5 million rubles. The court also interrogated the guards who participated in the arrest of Vinogradov [35] . During the interrogation of one of the witnesses, it became known that Vinogradov’s backpack seemed suspiciously large to the office workers, but he reassured them, saying that after work he was going to go to the Carpathians to rest [63] .
On September 3, the amount of money suits filed by the relatives of the victims of Vinogradov rose to 5 million rubles. Also on this day, the mother of the murderer spoke in court, who asked the court not to punish her son too severely, since he had poor physical health and a closed character, also suffering from psychological problems and being prone to suicide [64] .
On September 5, the prosecution demanded that the court sentence Vinogradov to life imprisonment in a special regime colony, with periodic visits to a psychiatrist at the place where the sentence was served. Moscow Prosecutor Sergei Kudeneev [65] [66] made an accusatory speech. According to him, the guilt, which the shooter himself admitted, has been fully proven and the court has no extenuating circumstances for a different sentence [67] . The victims supported the opinion of the prosecutor on the need for life imprisonment, but expressed regret that it was impossible to sentence him to death [68] .
At the end of the meeting, Vinogradov was given the last word [46] :
I did not want to kill anyone. The manifesto did not want to write in this form. What self-affirmation can be ... I myself wanted to shoot myself ... I can say: do not take an example from me.
Sentence
September 9, 2013 the last meeting on the case of Vinogradov was held. He was convicted on all counts and sentenced to life imprisonment [69] with compulsory treatment by a psychiatrist at the place where the sentence was served [1] [70] . At the same time, Vinogradov was found guilty of disseminating calls for extremist activity , for which he was fined 300,000 rubles [70] . The court also satisfied civil claims of the relatives of those killed in the amount of 10 million rubles [70] .
The defense appealed the verdict, believing it to be unfounded and arguing that Vinogradov suffers more severe mental illnesses than those that were revealed during the forensic psychiatric examination, and at the time of the commission of these acts was in a state of irresponsible [71] [72] . The arguments of the complaint were refuted by a representative of the General Prosecutor's Office, and on November 28, 2013 the judicial panel on criminal cases of the Supreme Court of the Russian Federation left an appeal without satisfaction [8] .
In conclusion
After approval of the verdict by the Supreme Court, Vinogradov was transferred to a special regime penal colony for life prisoners in Solikamsk , known as the “White Swan” . The shooter was placed in a triple chamber [9] .
In conclusion, Vinogradov was fascinated by the reading of fiction and popular science literature [9] , in particular, by the works of the English astrophysicist Stephen Hawking . He also issued monthly subscriptions to The New Times , " Amateur " and " In the World of Science " magazines [73] .
In October 2013, in the interval between the sentencing and its approval by the Supreme Court, a version appeared in the media about the alleged murder by Vinogradov on the Oka River of two crossbowmen in the summer of 2009 with the aim of revenge for their destruction of nature. According to cellmates Vinogradov, he allegedly spoke about the desire to write a book about the dangers of humanity for nature (an extended version of the former manifesto), which he planned to begin by describing his first murders. Vinogradov himself explained to a journalist through a lawyer that he did not tell anything like this in prison and had never been on the bank of the Oka [74] . The General Prosecutor’s Office began a trial of a case in which Muscovite Sergey Dudenko had been convicted earlier for 19 years and 6 months [75] . In January 2014, the investigative department of the Investigative Committee of the Russian Federation for the Kaluga Region reported that during the inspection, Vinogradov was not involved in these killings [76] .
