The powers, procedure for the formation and activities of the Constitutional Court of the Republic of Bashkortostan are determined by the Constitution of the Republic of Bashkortostan and the law of the Republic of Bashkortostan “On the Constitutional Court of the Republic of Bashkortostan”. The Constitutional Court of the Republic of Belarus consists of 5 judges appointed by the State Assembly - Kurultai of the Republic of Bashkortostan on the proposal of the President of the Republic of Bashkortostan .

Structure

The Head of the Constitutional Court is the President of the Constitutional Court of the Republic of Bashkortostan.

In accordance with Article 12 of the Law of the Republic of Bashkortostan dated October 27, 1992 No. BC-13/7 (as amended on July 13, 2009) “On the Constitutional Court of the Republic of Bashkortostan”:

1. Proposals for candidates for the post of Chairman of the Constitutional Court of the Republic of Bashkortostan, deputy chairman of the Constitutional Court of the Republic of Bashkortostan, judges of the Constitutional Court of the Republic of Bashkortostan may be submitted to the President of the Republic of Bashkortostan by deputies of the State Assembly - Kurultai of the Republic of Bashkortostan, state authorities of the Republic of Bashkortostan, representative bodies of local self-government, bodies of local government, bodies judicial community of the Republic of Bashkortostan, legal scientific and educational institutions from among individuals with an impeccable reputation, with recognized high qualifications in the field of law. 2. The President of the Constitutional Court of the Republic of Bashkortostan is appointed by the State Assembly - the Kurultai of the Republic of Bashkortostan on the proposal of the President of the Republic of Bashkortostan. 3. The Deputy Chairman of the Constitutional Court of the Republic of Bashkortostan, judges of the Constitutional Court of the Republic of Bashkortostan are appointed by the State Assembly - the Kurultai of the Republic of Bashkortostan on the proposal of the President of the Republic of Bashkortostan, which is introduced taking into account the opinion of the President of the Constitutional Court of the Republic of Bashkortostan. 4. Nomination of candidates for the post of Chairman of the Constitutional Court of the Republic of Bashkortostan, Deputy Chairman of the Constitutional Court of the Republic of Bashkortostan, and judges of the Constitutional Court of the Republic of Bashkortostan shall be made in accordance with the procedure established by this Law and the Rules of Procedure of the State Assembly - Kurultay of the Republic of Bashkortostan. 5. In the event of termination of the powers of the President of the Constitutional Court of the Republic of Bashkortostan, deputy chairman of the Constitutional Court of the Republic of Bashkortostan, judge of the Constitutional Court of the Republic of Bashkortostan, the idea of ​​appointing another person to a vacant post shall be submitted by the President of the Republic of Bashkortostan to the State Assembly - Kurultai of the Republic of Bashkortostan no later than two months from the date of opening vacancies. (as amended by the Law of the Republic of Belarus dated 07.11.2006 No. 371-z).

Powers of the Constitutional Court of the Republic of Bashkortostan

According to Article 3 of the Law of the Republic of Bashkortostan “On the Constitutional Court of the Republic of Bashkortostan”: the Constitutional Court of the Republic of Bashkortostan in order to protect the constitutional order of the Republic of Bashkortostan, human and civil rights and freedoms, to ensure the highest legal force of the Constitution of the Republic of Bashkortostan on issues within the jurisdiction of the Republic of Bashkortostan:

1) resolve cases on compliance with the Constitution of the Republic of Bashkortostan:

  • laws of the Republic of Bashkortostan;
  • normative legal acts of the State Assembly - Kurultay of the Republic of Bashkortostan;
  • regulatory legal acts of the President of the Republic of Bashkortostan;
  • regulatory legal acts of the Government of the Republic of Bashkortostan and other republican executive bodies;
  • regulatory legal acts of local government bodies of the Republic of Bashkortostan;
  • regulatory legal acts of local governments;
  • on complaints of violation of constitutional rights and freedoms of citizens, checks the constitutionality of a normative legal act of a public authority of the Republic of Bashkortostan, a local government;
  • gives an interpretation of the Constitution of the Republic of Bashkortostan;
  • advocates legislative initiative in matters of its jurisdiction;
  • considers other constitutional legal issues referred to its competence by federal law and the law of the Republic of Bashkortostan.

2. The Constitutional Court of the Republic of Bashkortostan may be vested with other powers, if they do not contradict its legal nature and designation as a body of constitutional review, comply with the limits of jurisdiction of the Republic of Bashkortostan and the powers of the Republic of Bashkortostan in matters of joint jurisdiction of the Russian Federation and the Republic of Bashkortostan and are not within the competence Constitutional Court of the Russian Federation , other courts.
