2004 - defended his doctoral dissertation on the topic “Compulsory medical measures (theory, criminal law regulation, practice)” at the Moscow State Academy of Law .

2005-2009 - Deputy of the Arkhangelsk Regional Assembly of Deputies of the 4th convocation (faction " Our Motherland - Arkhangelsk Region ", formed by the bloc of the Yabloko and SPS parties). Deputy corps elected deputy chairman of the committee on legislation and judicial and legal issues of the regional Assembly; Member of the Legislative Committee of the Parliamentary Association of the North-West of Russia.

The parliamentary activity of B. A. Spasennikov was aimed at strengthening law and order, public control over the activities of the qualification board of judges, and social protection of law enforcement officers and their families.

Author (co-author) of a number of bills that have received the force of federal and regional laws (draft federal law “On Amending Article 264 of the Criminal Code of the Russian Federation” [1] ; draft regional law “On Amending the Charter of the Arkhangelsk Region”; draft regional law " On introducing amendments to article 5 of the regional law “On public representatives in the qualification board of judges of the Arkhangelsk region”, etc.).

Scientific Activities

Medicine

B. A. Spasennikov established the patterns of the course of dyscirculatory encephalopathy (DE); specified the clinical criteria of its stages, taking into account the pathogenetic mechanisms of cerebral circulatory insufficiency associated with impaired receptor systems; substantiated and proved in practice the possibility of a fundamentally new methodological approach to the differentiated clinical and pharmacological use of drugs affecting cerebral metabolism, in order to increase the effectiveness of treatment of patients suffering from DE.

Revealed the pathogenetic expediency of prescribing cerebroprotective agents based on an experimental analysis of various models of cerebral hypoxia. The results of his research allowed determining the role of the GABA-BD-Cl-ionophore receptor complex in the pathogenesis of DE, the significance of the dynamic equilibrium between glutamate excitation and GABA inhibition.

The scientist systematized the syndromological assessment of DE, for the first time he studied the prognostic value of clinically significant values ​​in the dynamics of the pathological process. Based on a comprehensive analysis of clinical data, using modern methods of research and processing of the obtained results, they studied the possibility of using medical agents for altering cerebral metabolism, with a good clinical effect, to carry out medical correction of cerebral vascular disorders.

B. A. Spasennikov analyzed and summarized clinical material on the effect of metabolic agents on the severity of manifestations and the course of dyscirculatory encephalopathy depending on the timing of their use, and traced the dynamics of cerebral deficiency. Expanded the possibilities of pathogenetic and pathophysiological analysis of dyscirculatory encephalopathy. He studied the spectrum of pharmacological activity of previously unused patients for the treatment of patients suffering from DE and identified the leading factors that determine the effectiveness of the therapy. He described the options for the dynamics of neurophysiological and ultrasound indices when using cerebroprotective agents in cerebrovascular disease, indicating their clinical correlates. He developed indications for the use of cerebroprotective drugs and determined their optimal therapeutic doses, established the dependence of the positive effect on the dose.

The results obtained by B. A. Spasennikov broaden the diagnostic possibilities for assessing the patient's condition with dyscirculatory encephalopathy, determining the prognosis of the disease, choosing the optimal treatment method, and monitoring the effectiveness of the therapy. He studied the clinical manifestations of DE on the background of cerebroprotective therapy; individual properties were established for each preparation, which are made up of a different ratio of inhibitory and activating effects on the central nervous system. A technique has been developed for applying modern drugs affecting the GABA-BD-Cl-ionophore-receptor complex under conditions of neuro-resuscitation, neurological, polyclinic, rehabilitation departments, taking into account indications, contraindications, side effects, “withdrawal” syndromes, terms of use and administration methods. The individual optimal selection of cerebroprotective drugs of various pharmacological action was determined. The clinical use of modern drugs in the complex therapy of dyscirculatory encephalopathy, pathogenetically substantiated by scientists, made it possible to increase the effectiveness of the therapy, reduce disability and disability in this socially significant pathology [2] .

B. A. Spasennikov developed methods of positive psychotherapy for the correction of deviant (criminal) behavior [3] .

Spasennikov, a professional psychiatrist, doctor of medical sciences, compares favorably with many other studies" [4] . The conclusions of B. A. Spasennikov are based on a deep retrospective historical and legal analysis of domestic and foreign legislation, a comparative analysis of modern foreign legislation, special criminological studies of a wide range of empirical data, and an extensive list of literature.

In his writings, B. A. Spasennikov points to the inadmissibility of resolving the issue of the “insanity” of a person by forensic psychiatrists, considering that the decision of this question is the prerogative of the court [5] . Specifying the grounds for applying compulsory medical measures, which, according to the scientist, are vaguely formulated in the Criminal Code of the Russian Federation, he focuses on the fact that mental disorder should influence a person’s behavior when he commits a socially dangerous act. B. A. Spasennikov sharply criticizes the tendency to recognize persons with mental illness as irresponsible, regardless of the assessment of the effect of these diseases on behavior at the time of the act [6] .

In addition, B. A. Spasennikov deeply analyzes the problem of the “danger of mentally ill persons to society”, related to the duration of the application of compulsory medical measures. Considers various aspects of exemption from punishment for people who have a mental disorder after committing a crime, which makes it impossible for them to be aware of the actual nature and social danger of their actions (inaction) or to lead them. Believes that such a release is a “right”, but not a “duty” of the court [7] .

Indicates that part 4. Art. 97 of the Criminal Code, essentially drops out of the “coercive measures of a medical nature” and proposes a new legal mechanism for the prevention of socially dangerous acts by persons “who do not pose a danger in their mental state” [8] .

A supporter of introducing into the Criminal Code of the Russian Federation the concept of “state of responsibility”, suggests to define it as “the ability to consciously willful behavior during the commission of a crime” [9] .

The scientist proposes to exclude from Art. 21 of the Criminal Code of the Russian Federation “a different morbid state of mind”, replacing it with “a different mental disorder” [10] .

B. A. Spasennikov - a supporter of life-long forced outpatient monitoring and treatment of persons who committed socially dangerous acts, suffering from chronic mental disorder or dementia [11] .

He considers it incorrect to use the phrases “limited sanity” and “age insanity”, criticizes the proposal to include mental disorders in the list of circumstances mitigating punishment [12] .

B. A. Spasennikov also makes a proposal to reduce the age of persons subject to criminal responsibility to twelve years [13] .

It offers the definition of intoxication as “a mental disorder as a result of the introduction into the human body of substances that have a psychotropic, neurotoxic effect on the brain” [14] .

Expresses doubts about the appropriateness of Art. 107, 113 of the Criminal Code of the Russian Federation, in which the commission of crimes in the heat of passion is considered as a circumstance that is the basis for the appointment of a milder punishment [15] .

Having analyzed, from the point of view of medicine and law, the goals of coercive measures of a medical nature, suggested clarifying wording of art. 98-102 of the Criminal Code of the Russian Federation [16] .
