The Head of the Republic of Dagestan is the head of the republic (state) [1] and the highest official who heads the system of executive bodies of state power of the Republic of Dagestan .

The head of Dagestan pursues a policy aimed at ensuring compliance with the Constitution of the Russian Federation and federal laws, the Constitution of the Republic of Dagestan and the laws of Dagestan, as well as equality of peoples, human and civil rights and freedoms, and preserving the unity and territorial integrity of the Republic of Dagestan . A person under the age of 30 may not be the head of the Republic.

The term of office is five years. He is elected by the deputies of the People’s Assembly of the Republic of Dagestan from among three candidates submitted by the President of the Russian Federation.

History

State Council Chairman

Since 1994, the highest executive power in the Republic of Dagestan was exercised by the State Council of the Republic of Dagestan, which was elected by the Constitutional Assembly and which included representatives of 14 "main" Dagestan peoples. Since 1994, the Chairman of the State Council of Dagestan has been Magomedali Magomedov , a Dargin by nationality. [2]

In the summer of 2002, the Constitutional Assembly of the Republic of Dagestan again elected Magomedali Magomedov as chairman of the State Council. His term of office was 4 years.

In 2003, in the course of building the Kremlin’s vertical of power and bringing regional legislations into line with the Constitution of the Russian Federation, a new constitution was adopted in Dagestan. On July 10, 2003, the Constitutional Assembly adopted a new Constitution of the Republic of Dagestan , in accordance with which the position of the President of the Republic was introduced in the republic . The first direct and popular elections of the president of the republic were to be held in 2006, after the end of the term of office of the current composition of the State Council of the Republic of Dagestan, which was abolished.

However, in 2004, at the initiative of the President of Russia V. V. Putin, the election of senior officials in all constituent entities of the Russian Federation was changed to the appointment by the legislative bodies upon the proposal of the President of Russia [3] . The current heads of the constituent entities of the Russian Federation were given the opportunity to apply to the president for reappointment. In 2005, the Constitutional Court of the Russian Federation confirmed the constitutionality of the appointment of the heads of constituent entities of the Russian Federation, in effect having revised its legal position 10 years ago [4] .

President

February 16, 2006, the Chairman of the State Council of Dagestan, 75-year-old Magomedali Magomedov, whose term of office expired only in June 2006, after meeting with Russian President Vladimir Putin, said he decided to resign early [5] Through Presidential Envoy in the Southern Federal District Dmitry Kozak to Putin Three candidates nominated by the outgoing head of the republic, the Union of local authorities and a number of public organizations were proposed. On February 20, President Putin submitted the candidature of Mukhu Aliyev to the People’s Assembly of the Republic of Dagestan to grant him the powers of the President of the Republic of Dagestan for a period of 4 years [6] . The deputies approved Aliyev’s candidacy almost immediately - within a few hours. 101 deputies of the National Assembly of the Republic voted for Aliyev’s approval, one parliamentarian was against.

Mukhu Aliyev’s presidential term ended in February 2010, but already on November 19, 2009, the United Russia party submitted a list of presidential candidates for Dagestan’s presidency to the Russian President Dmitry Medvedev [7] . Medvedev chose one of the five candidates proposed to him - Magomedsalam Magomedov - and submitted it for approval to the Dagestan parliament. On February 10, 2010, the People’s Assembly of Dagestan unanimously approved Magomedov as the new president of the republic. On February 20, Magomedov took the oath and officially assumed the office of President of Dagestan. His term of office was 5 years.

Chapter

In December 2010, Russian President Dmitry Medvedev signed a law that forbade calling the heads of subjects of the Russian Federation the word "president", while the regions could choose the name for the leader in accordance with their historical traditions. The regions had to bring their constitutions or statutes in line with the adopted law before January 1, 2015. In July 2011, deputies of the People’s Assembly of the Republic of Dagestan unanimously supported the law on amendments to the constitution of the republic, changing the name of the highest post from “ President of the Republic of Dagestan ” to “ Head of the Republic of Dagestan ”. The changes approved it immediately in two readings [8] , and then the law was signed by the President of Dagestan M. Magomedov . The law came into force on January 1, 2014 [9] [10] .

In May 2012, at the initiative of Russian President Dmitry Medvedev, a federal law was passed providing for the return of direct elections of heads of regions. The law came into force on June 1, 2012 [11] . According to this law, the first election of senior officials was to be held on October 14, 2012 in those constituent entities of the Russian Federation, where the expiration of the powers of existing senior officials expire from June 1 to December 31, 2012. [12] In June 2012, the People’s Assembly of Dagestan adopted the law “On the election of the President of the Republic of Dagestan”, according to which the president of the republic is elected by direct popular vote, but self-promoted candidates cannot take part in the elections, and party candidates must overcome the 10-year Municipal-percentage barrier. The head is elected for a term of 5 years and cannot hold the specified position for more than two consecutive terms [13] .

In the fall of 2012, a law on a single voting day was adopted, according to which elections in Russia will be held only once a year - on the second Sunday of September [14] . Previously, regional and local elections were held twice a year - in March and October.

On January 23, 2013, the early resignation of the President of the Republic of Dagestan, Magomedsalam Magomedov, took place - he officially resigned at his own will. And on January 28, Russian President Vladimir Putin appointed Ramazan Abdulatipov Acting President of the Republic of Dagestan [15] . It was assumed that Abdulatipov would lead the republic until September 2013, when the early presidential elections of the Republic of Dagestan were to be held.

April 1, 2013 temporary and. about. President of Dagestan, Ramazan Abdulatipov said that Dagestan could refuse to hold direct elections for the head of the region. In his opinion, the parliament will most likely be chosen as the head, since it is necessary to take into account the specificity of the republic. At the same time, Abdulatipov said that he was closer to the nation-wide election in which he was ready to run. [16] On April 18, the deputies of the National Assembly of Dagestan voted for the opportunity to independently appoint the head of the republic. 74 deputies voted in favor, 9 deputies voted against, three abstained. Thus, the Republic of Dagestan became the first subject of the Russian Federation, which refused to directly elect the head of the region. [17]

Then the deputies of the National Assembly decided that to vote on candidates for the office of President of the Republic, they would gather at an extraordinary session on the United Day of Voting on September 8, 2013 . On August 19, Russian President Vladimir Putin submitted three candidates for the post of head of the republic to the consideration of the Dagestan People’s Assembly: and. about. Ramazan Abdulatipov, President of Dagestan; Malik Bagliev, Minister of Labor and Social Development of the Republic; and Ummupazil Omarov, Ombudsman for Dagestan. On September 8, 2013, the deputies of the National Assembly by a majority vote elected Ramazan Abdulatipov as president of Dagestan. 86 out of 88 deputies voted for his candidacy. Within half an hour Abdulatipov took the oath and took office. [18]

On October 3, 2017, Russian President Vladimir Putin appointed the Acting Head of Dagestan as Deputy Chairman of the State Duma Vladimir Vasilyev (Kazakh by father and Russian by mother), thus, for the first time in modern history, not one of the largest peoples of Dagestan became the head of the republic.

Entry into office

The head takes office on the thirtieth day after his election, from the moment he took the following oath to the people: “I swear to faithfully serve the multinational Dagestan people, abide by the Constitution of the Russian Federation, federal laws, the Constitution of the Republic of Dagestan and the laws of the Republic of Dagestan, respect and protect human and civil rights and freedoms , unity and territorial integrity of the Republic of Dagestan, honestly and conscientiously fulfill the high duties assigned to me by the Head of the Republic of Dagestan. ”

The oath is taken in a solemn ceremony in the presence of deputies of the National Assembly of the Republic of Dagestan and judges of the Constitutional Court of the Republic of Dagestan. The head swears by the Constitution of the Republic . After taking the oath, the National Anthem of the Republic of Dagestan is performed.

Powers

  • 1) appoints the Chairman of the Government of the Republic of Dagestan;
  • 2) upon the proposal of the Chairman of the Government of the Republic of Dagestan, forms the Government of the Republic of Dagestan;
  • 3) presents to the People’s Assembly of the Republic of Dagestan candidates for the appointment of judges of the Constitutional Court of the Republic of Dagestan, justices of the peace;
  • 4) decides on the early termination of the powers of the National Assembly of the Republic of Dagestan, if it adopts a law or other regulatory legal act contrary to the Constitution of the Russian Federation, federal laws adopted in the jurisdiction of the Russian Federation and joint jurisdiction of the Russian Federation and the Republic of Dagestan, the Constitution of the Republic Dagestan, if such contradictions are established by the relevant court, and the People’s Assembly of the Republic of Dagestan did not eliminate them in time, the established law om;
  • 5) appoints the date of extraordinary elections to the People’s Assembly of the Republic of Dagestan in the event of an early termination of the powers of the People’s Assembly of the Republic of Dagestan;
  • 6) decides on the resignation of the Government of the Republic of Dagestan, members of the Government of the Republic of Dagestan;
  • 7) appoints and recalls, after consulting with the relevant committees of the National Assembly of the Republic of Dagestan, representatives of the Republic of Dagestan;
  • 8) approve, at the proposal of the Chairman of the Government of the Republic of Dagestan, the list of republican bodies of executive authority;
  • 9) conducts personnel policy;
  • 10) forms and heads the Security Council of the Republic of Dagestan;
  • 11) forms the Administration of the President of the Republic of Dagestan;
  • 12) awards state awards of the Republic of Dagestan, confers honorary and special titles of the Republic of Dagestan, and presents them with state awards of the Russian Federation;
  • 13) conducts negotiations and signs agreements and other agreements on behalf of the Republic of Dagestan;
  • 14) signs and promulgates the laws of the Republic of Dagestan, issues decrees and orders;
  • 15) refers to the People’s Assembly of the Republic of Dagestan with an annual message on the situation in the republic;
  • 16) has the right to participate and make an extraordinary speech at meetings of the National Assembly of the Republic of Dagestan;
  • 17) submits to the People’s Assembly of the Republic of Dagestan a draft republican budget of the Republic of Dagestan and a report on its execution, draft social and economic development programs of the Republic of Dagestan and reports on their implementation;
  • 18) exercise other powers in accordance with the Constitution of the Russian Federation, federal laws, the Constitution of the Republic of Dagestan and the laws of the Republic of Dagestan, as well as treaties and agreements concluded on behalf of the Republic of Dagestan.

Early release from office

The Head of the Republic of Dagestan may be prematurely removed from office in the following cases:

  • 1) his death;
  • 2) his resignation in connection with his expressing no confidence in the National Assembly of the Republic of Dagestan;
  • 3) his resignation at his own request;
  • 4) his removal from office by the President of the Russian Federation in accordance with federal law;
  • 5) his recognition by the court as incapable or partially capable;
  • 6) recognition by the court as missing or declaring him dead;
  • 7) the entry into force of a court conviction against him;
  • 8) his departure from the Russian Federation for permanent residence;
  • 9) the loss of citizenship of the Russian Federation;
  • 10) its withdrawal by voters on the basis and in the manner prescribed by law.
