Shariah Guard

The Shariah Guard ( Arabic: مطوعين - mutavva`in ) - armed groups (religious police), designed to carry out decisions of Shariah courts up to the death penalty . Sharia guard units are an integral part of the Ministry of Internal Affairs in a number of Islamic countries.

Sharia court

Unlike European law, decisions in Sharia courts are not made by the jury, but personally by the Cadi (Sharia judge) in the district court of first instance. The plaintiff and defendant themselves appear in court in person, the lawyer only prepares documents and consults at the pre-trial stage.

Three cadis make decisions in the appellate court of the district. There is no appeal in Sharia. The Supreme Judicial Council (among the Sunnis) or the Mujtahid of the Judiciary (Iran) is formed in the judicial system, which appoint all the judges and are the supervisory authority. Juries are not formed due to the fact that in the doctrine of Islamic law, the qadi is obliged to help the parties in resolving the conflict and he is a fakih, that is, an expert on law.

Saudi Arabia

In Saudi Arabia, the Shariah Guard is subordinate to the Committee for the Promotion of Virtue . The total number of the Shariah Guard of Saudi Arabia is about 3,500. Quite often, clashes occur between the Shariah guard and the elite National Guard in the kingdom due to the actions of the Shariah guard.

The Saudi Sharia Guard has the right to collect and investigate complaints, as well as to detain suspects. Shariah guards also patrol streets and public places in order to prevent acts of alcoholism, drug sales, prostitution, hooliganism, theft. They also carefully monitor the observance of decency in clothing . In April 2016, it became known that, according to the new law, the Sharia guard was deprived of the right to detain suspects, and should only report them to ordinary police officers [1] .

Russia (CRI)

In CRI, the Shariah guard had official status as an enforcement agency of the Ministry of Shariah Security of CRI in 1998-1999. Her actions (clashes in Gudermes) at one time led to an aggravation of the situation .

Afghanistan

The Ministry for the Promotion of Virtue and the Punishment of Sins , established under the Rabbani regime ( Islamic State of Afghanistan ), flourished during the Taliban dictatorship in the Islamic Emirate of Afghanistan , after the invasion of the coalition forces, it was first disbanded and then restored in 2003 by the President of the Supreme Court and in 2006 was reorganized by President Karzai into a department within the Ministry of Hajj and Religious Affairs.
