Compulsory insurance against industrial accidents and occupational diseases
Compulsory social insurance against accidents at work and occupational diseases is carried out in the Russian Federation in accordance with the Federal Law “On Compulsory Social Insurance against Accidents at Work and Occupational Diseases” dated July 24, 1998, 125-ФЗ from January 1, 2000. the law established the legal, economic and organizational basis for this type of insurance , the procedure for compensation for damage caused to life and health of the insured Deeds and when engaged by their employment agreement (contract) in the other established hereby cases [1] .
The insurers for this type of insurance are: a legal entity of any legal form , including foreign organizations operating in Russia and employing citizens of the Russian Federation, or an individual using employees who are subject to compulsory social insurance against industrial accidents .
The insurer for this type of insurance is the Social Insurance Fund of the Russian Federation [2] .
Insurance Goals and Objectives
The main task of this type of insurance is the social protection of the insured in case of an insured accident or occupational disease that resulted in a temporary or permanent loss of professional disability. In the event of the death of the insured, social protection is provided for dependents and other citizens eligible for insurance coverage in connection with the death of the breadwinner [1] .
Along with this, this type of insurance is designed to ensure the economic interest of insurance subjects (the insured, the insured, the insurer) in reducing occupational risk by setting differentiated insurance tariffs ;
Compensation of harm caused to the life and health of the insured in the performance of his duties under an employment contract (contract) and in other 125-ФЗ cases established by the Federal Law of July 24, 1998, is carried out by providing the insured with all necessary types of security for this type of insurance, including the cost of medical, social and vocational rehabilitation.
With the help of insurance funds formed at the expense of insurance premiums for this insurance, funding is provided for preventive measures to reduce industrial accidents and occupational diseases. In accordance with Article 17 of the Federal Law dated December 19, 2006 No. 234-ФЗ “On the Budget of the Social Insurance Fund of the Russian Federation for 2007”, the Fund has the right to decide whether the insurer to send up to 20 percent of the insurance premiums to finance preventive measures to reduce industrial injuries occupational diseases of workers and sanatorium-resort treatment of workers engaged in work with harmful and (or) dangerous production factors [1] .
Insurance premiums
Insurance protection is provided mainly at the expense of cash funds formed from compulsory insurance contributions of policyholders, capitalized payments received by the insurer in the event of liquidation of policyholders, as well as the collection of fines , penalties and other income not contradicting the legislation of the Russian Federation [1] .
The size of insurance tariffs is established depending on the types of economic activity on the basis of the All-Russian Classification of Economic Activities. The classification of economic activities by occupational risk classes is approved by the Ministry of Health and Social Development of the Russian Federation. In total, 32 classes of professional risk have been allocated [3] .
The insurance rates for compulsory social insurance against industrial accidents and occupational diseases for policyholders are subject to discounts and allowances in accordance with the Rules approved by Government Decree of September 6, 2001 No. 652 [1] .
