Criminal case
On October 26, 2012 it became known that a criminal case was initiated against Kudryavtsev and he was charged under Part 1 of Art. 286 and Part 4 of Art. 159 of the Criminal Code. Kudryavtsev and head of the Moscow Institute of Architecture, Professor Ilya Lezhava were accused of abuse of office and fraud with shared participation in the construction of a residential house in Moscow to improve the living conditions of the university’s teaching staff, in particular, they were charged with embezzling 127 million rubles of earmarked contributions [4] . The investigation was completed on July 18, 2013. According to the findings of the investigation, the academicians kidnapped more than 127.3 million rubles belonging to the co-investors, spending them on the purchase of 11 apartments to the teachers of the institute. Kudryavtsev and Lezhava do not admit their guilt. The defendants built their defense on the fact that the preliminary courts established - the institute fulfilled in full all obligations to co-investors, transferring to them their shares in the house under construction. The case was transferred to the Meshchansky District Court [5] .
According to Kudryavtsev, subject to the terms of the contract for the construction of a house in Zvonarsky Lane MARHI, he fully fulfilled his obligations [6] . Eight people (people who did not receive the apartments), recognized as the result of the victims, refused any claims to Kudryavtsev and Lezhava, asking them to be excluded from the number of victims [7] . The defendants did not deny that in fact attracted private investors to the construction. However, this was done for a specific purpose: it was planned to build luxury apartments in a house in Zvonarsky Lane, with a floor area of 120-180 square meters and a cost of 14-15 million rubles [8] . The management of the institute decided to sell the rights to these apartments in order to purchase cheaper housing in other houses, but to provide them with a larger number of employees of the institute. [eight]
On June 27, 2014, the Meshchansky District Court (judge Elena Maximova) passed the verdict. The accusation of fraud (Article 159 of the Criminal Code of the Russian Federation) was reclassified to the article “causing property damage by deception or abuse of trust in the absence of signs of theft, committed by a group of persons by prior agreement or on a large scale” (Article 165 part 2 of the Criminal Code of the Russian Federation). As a result, Kudryavtsev was found guilty and sentenced to one year of imprisonment . At the same time, he was acquitted on charges of abuse of office (Article 286 of the Criminal Code of the Russian Federation). At the same time, the court did not satisfy the civil lawsuit filed by MARCHI representatives as the injured party in the amount of 118 million rubles. As explained by the judge, the claimed amount has been changed several times, and therefore it should be clarified, and then the plaintiffs can seek compensation for damage during the civil process [9] [10] [11] .
On December 12, 2014, the Moscow City Court changed the sentence, reducing the term of a conditional sentence to 10 months and recognizing the expiration of the term of bringing Kudryavtsev to criminal responsibility under article 165 part 2 of the Criminal Code of the Russian Federation. In addition, from the court decision it follows that the amount of the damage caused is 9 million rubles, while the investigation initially called the amount of 127 million rubles [12] .
