Disclaimer ( English Disclaimer ) - a written disclaimer of liability for possible tort consequences of a particular act as a result of the actions of the person declaring this refusal or of third parties . Tort means any kind of liability of the applicant. Disclaimer appeared and became widespread in the United States of America, where it is still used everywhere, including in everyday life.
Legal nature of the phenomenon
The widespread dissemination of the disclaimer in the United States is due to the fact that it to some extent "blocks" the effect of the general legal principle "ignorance of the law does not exempt from liability for its violation." In other words, the applicant understands the possible responsibility for breaking the law (that is, knows the law), but at the same time does not guarantee that his action will entail liability. In other countries, including countries of the Romano-German legal family , the disclaimer can also be applied, only it will not carry the same legal force as in the countries of the Anglo-Saxon legal family and the applicant’s responsibility will still follow, regardless of whether the disclaimer was declared or was not.
