Criminal proceedings

On February 28, 2014, an investigation was launched in Geneva against Alexander Yanukovich and his father Viktor Yanukovych . They were suspected of corruption [26] .

On March 6, 2014, the European Union and Canada announced that Yanukovych and his father and younger brother are on the list of senior Ukrainian officials against whom financial sanctions are being introduced. [27] [28] [29] .

On April 18, 2014, the SBU put Alexander Yanukovich on the wanted list. He is suspected of committing a crime under Part 2 of Article 366 of the Criminal Code of Ukraine - official falsification, falsification of documents, as well as the preparation and issuance of knowingly false documents, which entailed serious consequences.

On January 12, 2015, a special commission of the International Police Organization, at the request of the Ukrainian side, put Alexander Yanukovich on the international wanted list of Interpol [30] .

On April 15, 2015, the SBU opened a criminal case against Mako Trading, owned by Alexander Yanukovych on suspicion of terrorist financing [31] .

In May 2017, Interpol documented that it removed Aleksandr Yanukovich from the wanted list and was not in the Interpol wanted database [32]

Litigation

On September 3, 2015, the Pechersky District Court of Kiev refused to satisfy Alexander Yanukovych’s claim against the Ministry of Justice of Ukraine and Verkhovna Rada of Ukraine Anton Gerashchenko (People’s Front faction) because of statements in November 2014 about the involvement of the son of ex-president of Ukraine Yanukovych B F. to the execution of Euromaidan activists in February 2014. This is stated in a photocopy of the court’s decision, published on the page of the press secretary of Alexander Yanukovych on the social network Facebook. According to the decision, the court considered Gerashchenko’s statements to be value judgments and pointed out that such judgments are not subject to refutation and punishment [33] .

On October 13, 2015, Alexander Yanukovych filed a lawsuit with the European Court of Human Rights in connection with regular violations of human rights by Ukraine against him and receiving material compensation for the loss of ownership of 100% of the shares of the All-Ukrainian Development Bank in the amount of the market value of the shares [34] . The basis for filing a lawsuit was the decision of the National Bank of Ukraine of November 27, 2014 to declare the All-Ukrainian Development Bank insolvent, which entailed the introduction of a provisional administration into the bank and its actual expropriation. As a result of this decision, the NBU Alexander Yanukovych lost ownership of 100% of the bank.

On March 3, 2016, the Pechersky District Court of Kiev seized 11 bank accounts in 3 banks that were opened by companies owned by Alexander Yanukovych, as part of a pre-trial investigation of May 8, 2014 on suspicion of taking possession of budget funds [35] . In particular, arrests were imposed on the accounts of Mako Holding, Mako Asset, and Building Investments Group. The court arrested 4 accounts with ING Bank NV (Netherlands), 5 accounts with Ukrbiznesbank and 2 accounts with the All-Ukrainian Development Bank (the last 2 are liquidated).
