Election Procedure

The President of the Republic of Moldova is elected by popular vote . A citizen who has the right to vote , has reached the age of 40 years, has lived or has been living on the territory of the Republic of Moldova for at least 10 years and speaks the state language can be elected President of Moldova. The candidate who receives 50% + 1 vote is considered elected. If none of the candidates won the required number of votes, a second round of voting shall be held for the first two candidates established in descending order of the number of votes received in the first round. In the second round of voting, the candidate with the most votes shall be declared the winner.

The results of the presidential election are recognized by the valid Constitutional Court. A candidate whose election is deemed valid no later than 45 days after the election shall take the following oath before the Parliament and the Constitutional Court:

“I swear to give all my strength and ability in the name of prosperity of the Republic of Moldova, to observe the Constitution and laws of the country, to protect democracy, fundamental human rights and freedoms, sovereignty, independence, unity and territorial integrity of Moldova.”

Term of office

The President of the Republic of Moldova is elected for a four-year term and takes office from the day the oath is taken. He exercises his powers until the oath of office by the newly elected president. The term of office of the president may be extended by organic law in the event of war or disaster. One and the same person may not hold the office of president for more than two consecutive terms.

  • appointment and dismissal of members of the Government on the proposal of the Prime Minister (according to the decision of the Constitutional Court, the head of state has the right to reject the proposal of the Prime Minister only once, which in fact reduces his role to the formalization of documents)
  • dissolution of the parliament (possible only in specific cases provided for in the Constitution - the impossibility of forming a Government or blocking the adoption of laws for three months, and the President must consult with parliamentary factions before making a decision)
  • Foreign Policy Powers:
    • the president negotiates, participates in negotiations, concludes international treaties on behalf of the country and submits them to parliament for ratification in the manner and terms established by law;
    • the president, at the proposal of the government, accredits and recalls diplomatic representatives of the Republic of Moldova and approves the establishment, abolition or change of rank of diplomatic missions;
    • The President accepts credentials and recalls from diplomatic representatives of other states in the Republic of Moldova.
  • defense authority
    • the president is the commander in chief of the armed forces (this provision of the Constitution can be perceived as symbolic, since the real control of the armed forces is carried out by the Minister of Defense, which, according to the decision of the Constitutional Court, can be appointed without the participation and consent of the head of state);
    • the president may, with the prior consent of the parliament, announce partial or general mobilization;
    • in the event of armed aggression against the country, the president takes measures to repel aggression, impose martial law and immediately inform the parliament about this (counter-signaling is required, that is, all relevant decrees of the head of state come into force after they are approved by the prime minister). If the parliament is not at this time at the session, it shall be convened by law within 24 hours after the outbreak of aggression.
    • the president may take other measures aimed at ensuring national security and public order, within the limits of the law and in accordance with it (counter-signaling is required, that is, all relevant decrees of the head of state come into force after they are approved by the prime minister).
  • The President of the Republic of Moldova also exercises the following powers:
    • rewards state awards and confers honorary titles;
    • confers the highest military ranks prescribed by law;
    • resolves issues of citizenship of the Republic of Moldova and the provision of political asylum;
    • appoints to public office in accordance with the law;
    • carries out pardon;
    • may require the people to express their will on matters of national importance through an advisory referendum (the results of such a referendum will not have direct legal force);
    • assigns diplomatic ranks;
    • assigns, in accordance with the law, the highest class ranks to employees of the prosecutor's office, the courts and other categories of employees;
    • suspends the acts of the Government, contrary to the law, until the final decision of the Constitutional Court;
    • exercises other powers established by law.
