The Convention on Paid Leaves is the International Convention on Paid Leaves No. 132 of the International Labor Organization (ILO), revised in 1970. The Convention entered into force on June 30, 1973.
The Convention on Paid Leaves applies to all employed persons, with the exception of seafarers , and provides that each person to whom the Convention applies is entitled to annual paid leave of a fixed minimum duration of at least three working weeks for one year of work. [1] [2]
At the same time, official and traditional holidays and non-working days, regardless of whether they fall on the annual vacation period or not, are not counted as part of the minimum paid annual vacation. [2]
Each person enjoying the leave provided for in this Convention shall receive at least his normal or average wage for the full period of this leave. [2]
According to the Convention, agreements on the waiver of the right to a minimum annual paid leave or on the non-use of such leave with the replacement of its compensation are invalidated or prohibited. [2]
The Convention provides for the duration of the period of work giving the right to receive annual paid leave (6 months), the provision of the right to leave proportional to the duration of work in the case when the duration of work during any year is less than that required to acquire the right to full leave, and other provisions related to annual paid leave and the procedure for their provision. [3]
Ratification of the Convention
As of 2018, 37 states have ratified the Paid Leave Convention.
