Cognates (Roman law)

Cognates ( lat. Cognati - “relatives”) - in Roman law, persons who are legally recognized blood relations by the female line and generally blood relatives. In the late empire, cognates could be identified as heirs along with agnates . [one]

Description

In this type of kinship, all immediate relatives were considered to be the heirs ( lat. Cognati ) regardless of gender and in compliance with the sequence of degrees and order of birth. Possible heirs were divided into four categories. [2]

The first category consisted of the direct descendant relatives of the testator: sons, daughters from the right marriage, as well as grandchildren from children who died earlier, who were given the right to inherit instead of their parents and in the same shares. The second category was made up of ascending and full relatives: father, mother, grandmothers, full brothers and sisters, nephews of full brothers and sisters, who were given the right to inherit instead of their parents. The third category was composed of half-relatives: half-brothers and single-mother brothers and sisters. Other lateral relatives of all degrees of remoteness of kinship and infinity "to infinity" ( lat. Ad infinitum ) made up the fourth category. [2]
