His grandfather, Nathaniel Pendleton, served as an officer at the headquarters of General George Washington during the war, and later served as a judge in the United States District Court.

Pendleton was one of the leaders of the House of Representatives in 1862 to conduct impeachment proceedings against West N. Humphries, the District Judge of Tennessee . Pendleton took part in the presidential election of 1864 for the post of vice president along with George B. McClellan (a supporter of the continuation of the war). Their opponents were Abraham Lincoln (as president) and Andrew Johnson (as vice president). McClellan and Pendleton lost, gaining about 45% of the vote. In the same year, Pendleton was not even re-elected to Congress.

After the war, he opposed the Thirteenth Amendment to the US Constitution and the Civil Rights Act of 1866.

Pendleton also could not be elected to the 40th US Congress . He claimed the presidential nomination from the Democratic Party in 1868, was close to victory, but lost to Horatio Seymour . He was then an unsuccessful Democratic candidate for the post of Governor of Ohio in 1869, losing the election to Rutherford B. Hayes .

He temporarily left politics, returned to law practice and became president of the Kentucky Central Railroad Company, working in this position until he was elected to the US Senate from the Democrats in 1879.

He worked in the Senate from 1879 to 1885. During this time, he passed the Civil Service Law, which was a kind of reaction to the assassination of US President James A. Garfield .
