Under a storage agreement , one party (the keeper) undertakes to keep the thing transferred to it by the other party ( depositor ) and return this thing intact (paragraph 1 of Article 886 of the Civil Code of the Russian Federation ).
The Civil Code of the Russian Federation describes in sufficient detail the rules governing relations in the field of property storage contracts. Along with the general provisions (§ 1 of Ch. 47 of the Civil Code of the Russian Federation) relating to all types of storage agreement, the civil code includes rules on storage at the warehouse, responsible storage (§ 2 of Ch. 47 of the Civil Code of the Russian Federation) and special types of storage (§ 3 Ch. 47 of the Civil Code of the Russian Federation).
As a general rule, a storage contract is real. There are a number of features of the storage agreement: in those cases when the agreement is concluded with a professional custodian, it can be built as consensual (the thing is transferred within the time period provided for by the model storage agreement). Another feature of the storage agreement is that the storage agreement can be either paid or unpaid, unilateral or bilateral, it all depends on the conditions agreed upon by the parties in the text of the sample storage agreement.
The storage agreement may be an element of another agreement ( agreement of carriage , delivery , etc.), in which case the provisions on the storage agreement apply to the relations of the parties regarding storage of the thing.
The parties to the storage agreement are the depositor and the custodian. The depositor may be any natural or legal person, including not necessarily the owner of the property, but also another authorized person. In some cases, only certain individuals can deposit property, for example, only hotel guests. Citizens and legal entities can also act as custodians: any of them can accept property for storage, unless their constituent documents expressly exclude it. However, for the conclusion of certain types of storage agreements and for the storage of certain types of property, a special license is required.
