International legal personality

International legal personality - the ability of a subject of international law to be a party to international legal relations, in particular to conclude and implement international treaties .

International legal personality consists in the availability of relevant rights and obligations established by international law .

The legal personality of the primary and secondary subjects of international law is different. So for states, legal personality is universal, they own it in full from the moment of their creation. Nations and peoples who struggle for their self-determination are entitled to claim recognition by their subjects of international law only subject to certain conditions. International legal personality per se does not automatically follow from the exercise of their right to self-determination , as enshrined in the UN Charter .

The legal personality of an international intergovernmental organization is limited by the constituent document of this organization. Thus, their international legal personality is functional in nature, since it is limited by the goals and objectives of the international organization as enshrined in its constituent documents.
