Criminal Case

In 1997, Yukos acquired a 54% stake in East Oil Company (VNK). [10] The new board of directors of VNK took out the shares of a number of subsidiaries of the company (including Tomskneft, Achinsk Oil Refinery ) in offshore companies in the Bahamas , Belize and Cyprus . [10] In 2001, the Moscow prosecutor's office instituted criminal proceedings in this regard. On December 7, 2004, Bakhmina was summoned for another interrogation and detained. [10] [11] Since December 10, she was detained in the Moscow pre-trial detention center No. 6. The Russian Prosecutor General’s Office accused her of taking over the property and assets of Tomskneft-VNK in the amount of more than 18 billion rubles. In addition, Bakhmina was charged with tax evasion from an individual. At the same time, the Tomskneft company itself had no complaints against Bakhmina. Also, the case involved the sale of buildings owned by NK Yukos through shell companies. In the future, after the arrest of Khodorkovsky, she developed schemes for the sale of the company's property with a hammer in the country and abroad. [13]

In March 2005, Bakhmina went on a hunger strike after she was once again refused permission for telephone conversations: since being taken into custody, she was forbidden to talk on the phone with two young children. Nine days later she stopped it due to deteriorating health. [14] [15]

At a court hearing on November 9, 2005, the former head of Tomskneft, Leonid Filimonov, stated that the accusations against her were unfounded, as she was just an ordinary member of the board of directors and did not have a casting vote. [16] Bakhmina also stated in court that she did not have the right to sign, and only at the direction of her leaders did she prepare documents on the creation of subsidiaries. [17]

On April 19, 2006, the Simonovskiy District Court of Moscow convicted Bakhmina under paragraphs “a, b” of part 3 of article 160 of the Criminal Code of the Russian Federation (“Assignment or embezzlement”) and by paragraph 2 of article 198 of the Criminal Code of the Russian Federation (“Evasion of an individual from paying a tax or insurance contribution to state extrabudgetary funds ”) and sentenced to 7 years in prison with a sentence in a penal colony of general regime [11] (the judge, reading the text of the sentence, mentioned the maximum security colony, but then this statement was declared a reservation - women are sent to Russia only in the colony general mode).

Lawyer Mikhail Barshchevsky commented on the verdict against Bakhmina: “I can only say one thing: I don’t understand this verdict, I just don’t understand, I can’t say that it is right or wrong, I just don’t understand it. According to the information that was in the media, Bakhmina was found guilty of stealing as much as 8 billion rubles, while the robbed, injured person says, “I have nothing, I have everything in place.” 8 billion - where are they? That is, she, of them, as I understand it, didn’t get a penny. Yes, the construction of criminal law provides for the possibility of the so-called theft in favor of third parties, that is, when a person commits theft, he does not have anything from it, but transfers the stolen to third parties. Well, where are the third parties, who are they? Again, I did not understand from the media who Bakhmina committed the theft in favor of ” [18]

The cassation ruling of the Moscow City Court of August 24, 2006, the sentence of the Simonovsky District Court of Moscow of April 19, 2006 was amended: Bakhmina’s actions were re-qualified from Part 2 of Article 198 of the Criminal Code of the Russian Federation to Part 1 of Article 198 of the Criminal Code of the Russian Federation and in accordance with paragraph “a” of Part 1 of Article 78 The Criminal Code of the Russian Federation, the production of this article was discontinued. [11] As a result, the sentence of the Moscow City Court was reduced by six months. [11] After the decision was announced, the judge added that she could appeal to the court for a delay in the execution of the sentence due to the fact that she has young children: "If the district court refuses to satisfy the application, you can contact us with a complaint." On October 2, 2006, the Simonovsky court of Moscow refused to satisfy Bakhmina’s motion to postpone the execution of the sentence for 9 years until her youngest child reaches the age of 14. The court decision stated that the court “must take into account not only the presence of young children, but also the severity of the crime and the living conditions of the children. Bakhmina’s children were not left without supervision and care of relatives and relatives - father and grandmother. ” [8] In the second half of October 2006, Bakhmina was sent to serve her sentence in colony IK-14, located in Mordovia . Prison Sentence and Campaign for Release

On May 27, 2008, the Zubovo-Polyansky court of Mordovia refused Bakhmina parole. The refusal was motivated by the convict having four, although repaid, penalties [20] . The continued detention of Svetlana Bakhmina in prison gave rise to a public campaign for her release. On October 10, 2008, human rights activist Elena Bonner sent an open letter to Svetlana Medvedeva and Lyudmila Putin. The letter said: “Dear first ladies of Russia! In the Mordovian camp is a young woman Svetlana Bakhmina. She is in the last months of pregnancy, and her first two children have been deprived of maternal care for five years. I appeal to you, believing that you are simply not aware of it in the burden of family and state concerns. Otherwise, without my appeal, you probably would have managed to achieve a change in its position. I hope that your secretaries and assistants do not take care of your gentle souls so much as to keep silent about my brief letter. Stir the hearts of your husbands. And if they value your feminine and maternal essence in you, then you will awaken mercy in them. Moreover, one of them has a constitutional right of pardon, and the other only needs to say three words: "I'm not angry." Use your high position so that the future citizen or citizen of Russia is born free. ” [24] On October 15, 2008, members of the Public Chamber appealed to Russian President Dmitry Medvedev asking for pardon of Svetlana Bakhmina. [25] On December 7, 2008, a picket of human rights defenders was held in Moscow to mark the second anniversary of Bakhmina’s arrest. The appeal of the protesters said: “The political trial, the harsh sentence of the mother of two young children give every right to consider Svetlana Bakhmin the Russian political prison. We demand her immediate release, the release of all political prisoners in our country, and the cessation of political repression. ” [26] In October 2008 - April 2009, bakhmina.ru collected signatures under an appeal to the Russian president with a request to have mercy on Bakhmin. [27] On October 23, 2008, the appeal with 60,000 signatures was transferred to the reception of the President of the Russian Federation [28] According to statistics from the bakhmina.ru website, a total of 96,028 signatures were collected. On April 21, 2009, the Preobrazhensky court of Moscow granted the motion of Svetlana Bakhmina’s lawyers and decided to release Bakhmina on parole [29] The prosecution refused to appeal the court’s decision, stating that it considered it lawful and justified. Current Activities
