Scandal Kirkorov - Aroyan

In May 2004, at a joint press conference with Anastasia Stotskaya in Rostov-on-Don, the newspaper “Dona Gazeta” journalist Irina Aroyan asked the question: “What caused such a large number of remakes in your repertoire? Journalists tried to translate the topic into Stotskaya, and a woman correspondent from MTV asked her the question: "Nastya, what did you learn from Philip Kirkorov?" Kirkorov interrupted again:

Leaving the hall, Irina Aroyan told Kirkorov: “You are just a boor!”
Everything happened in the presence of the press, and fragments of the scandalous press conference were published (the video was first distributed on the Internet ; later, the video was broadcast on a number of television channels). The video became an Internet meme only some time after the scandal.

When the journalist left the hall, she was seized by Kirkorov’s bodyguards . They took away the camera and the recorder from Aroyan and disabled the equipment ^[13] .

Irina Aroyan after an unsuccessful attempt to resolve the conflict in pre-trial procedure (Philip Kirkorov did not consider himself guilty of anything and refused to apologize) at the end of June 2004 filed a lawsuit in one of the courts of Rostov-on-Don ^{[14] [15] [ 16]} . A criminal case was instituted against the singer under Article 130 of Part 2 of the Criminal Code of the Russian Federation (“Insult”). In the court case, the expert’s opinion appeared - the head of the experimental lexicography department of the Russian Language Institute V.V. Vinogradov of the Russian Academy of Sciences, Doctor of Philology, Professor A.N. Baranov, prepared at the initiative of Kirkorov's lawyers. The conclusion stated in particular ^[17] :

• "one. An insult as a speech act is necessarily directed to a specific person - the addressee of the insult. That is, a verbal act of insult requires the use of appropriate indecent expressions directed (addressed) to a specific person. In addition, the speech act of insult assumes that the speaker ascribes to the addressee a negative characteristic (one or more). ”
• "2. In the phrase (1)" F. Kirkorov : <...> I am annoyed by your pink blouse, your boobs and your microphone "I. Aroyan is not attributed to any negative characteristics expressed in indecent form (see also answer to question No. 5 )

In the phrase (2) “F. Kirkorov: Ah ?! BUT? Yes to me ... I don’t give a fuck about how you write ... Just like you ... I do not like lay people! Nonprofessionals have nothing to do here! ”I. Aroyan is credited with a negative characteristic - nonprofessionalism, while using the word literary Russian , which is not indecent.

F. Kirkorov (rhyming): “Yes ... Pussy!” Allows various interpretations . With one understanding, I. Aroyan in indecent form attributes some characteristic. At the second understanding, we are talking about a language game based on a rhyme with the word “star” and mutual hassle. Since the speech act of F. Kirkorov consists of one word and follows after the “yes” particle used in the meaning of the reaction-consent, it is impossible to establish in the context what exactly is meant - attribution of a characteristic or a language game with hassle. The representative of the private prosecutor, lawyer Vladimir Lifshits, as follows challenged the conclusion ^[19] :

They are built on sophisms - false conclusions, which at first glance seem correct, but based on a conscious violation of the rules of logic. So, the professor believes that the insult must necessarily contain a negative characteristic of the one to whom it is addressed. But this is not so. An insult may or may not contain a negative assessment. Is it possible to say that boots are shoes? Of course. But it cannot be argued that all shoes are only felt boots. You can offend by spitting in the face of a person. This action does not contain any negative characteristics.

We are all native speakers of the Russian language. We do not need to scientifically explain the meaning of the words “x”, “b”, “e” or “p”. It is clear to everyone that this is taboo vocabulary. To find out the meaning of the word “star” in the letter “p,” you just need to go into any gateway and ask the first drunk who comes across.

Despite the petition of Kirkorov's lawyers, the court refused to give the conclusion the status of an official linguistic examination, and it did not affect the verdict. On August 11, 2004, the Rostov-on-Don magistrate court found Kirkorov guilty of part 2 of article 130 of the Criminal Code of the Russian Federation (insult in a public place) and imposed a fine of 60,000 rubles with payment in favor of the state. The plaintiff’s lawyer V. Livshits emphasized that Irina Aroyan intentionally did not present any material claims to the pop singer as compensation for non-pecuniary damage; for the injured party, the conviction of Kirkorov was sufficient compensation. An official court order noted that “Kirkorov, being one of the most famous artists and a role model for young people, deliberately and cynically insulted Irina Aroyan.” Soon after, Kirkorov again insulted the journalist (correspondent of the Izvestia newspaper) using obscene language. ^{[15] [16] [20] [21] [22]}

The scandal negatively affected the popularity of Philip Kirkorov and his touring activities. A number of regional music radio stations of the FM band, as part of the boycott of the singer, excluded his songs from rotation on the air. Some regional branches of the popular music television channels Muz-TV and MTV Russia , while supporting the boycott, also refused to show video clips of Kirkorov. ^{[23] [24]}

After a scandalous conference, the next day, musician Levon Atayan created a remix of “Kirkorov Mazzdie”. The song was downloaded by more than 100,000 users in 2 days, and after that the musician Alexey Vishnya wrote the remix “Million Against”, which were later included in the concert program of Philip Kirkorov “King of Remakes”. According to some reports, the Philip Kirkorov Production company invited Levon Atayan to make a joint album, after the musician’s refusal, the company illegally released the album “Sam P ... ah ?! or Kirkorov MaZZDie !!! ”.

In June 2004, the Internet newspaper Dni.ru organized the Million Against Kirkorov campaign ( Say No to Kirkorov! ). The organizers of the action declared their main task to collect one million signatures under the appeal of protest. Philip Kirkorov in connection with this initiative said he was ready to abandon the title of Honored Artist of the Russian Federation . As a result, the declared million signatures were not collected - the organizers stopped the project immediately after the court verdict was passed, believing that the main goal was achieved - the perpetrator suffered a well-deserved public punishment. Over the two months of the online protest, more than two hundred thousand signatures were collected ^{[25] [26] [27]} .

The singer did not publicly agree with the court decision, but nonetheless did not appeal it in the manner prescribed by law. After a court decision was made on the claim of Irina Aroyan, Philip Kirkorov announced at the end of August 2004 that he was leaving the stage and curtailed his touring activities ^[28] . According to media reports, after the scandal before the end of 2004, the singer only once appeared at a social event in the capital (at the presentation of the Smash !! album), and, unlike usual practice, did not perform at it. In December 2004, at the recording of the concert on the occasion of the Golden Gramophone Prize, the pop singer made an absentee public apology to the insulted journalist (the concert was broadcast in early 2005). By this time, there was no talk of leaving Kirkorov’s stage. Irina Aroyan, commenting on the apologies of Kirkorov, said that for her this incident was completely exhausted. However, according to some media reports, the apologies were made in an ambiguous manner. ^{[27] [29] [30] [31] [32] [33] [34]}

The attitude of the most pop singer to the scandal at the press conference was not constant. At first he denied all guilt on his part; during the trial and after the verdict was justified by the fact that he was provoked; He expressed regrets about what had happened, but claimed that it was easier for him to work as a janitor than to apologize to Irina Aroyan ( "I am ready to revenge the streets, lick the yards, but I will never apologize to this presumptuous journalist" ). In early 2005, his apologies to the journalist were still voiced on the air. Finally, almost a year after the incident, Philip Kirkorov admitted in an interview with Ekho Moskvy that he, as a public person, had no right to overly emotional statements ^{[35] [36]} .

Nevertheless, the consequences of the scandal were felt on the career of a pop star in the first half of 2005 (according to the Kommersant newspaper, the singer managed to restore their previous positions on the Russian pop song only by 2007). So, under various pretexts, his joint concerts with the Greek singer Sakis Rouvas , one of the winners of Eurovision 2004, were postponed - the producers of the event feared that under the influence of the scandal the tickets would remain unsold. The joint tour of Kirkorov and Anastasia Stotskaya in Minsk in February 2005 was on the verge of collapse due to low demand for tickets. The concert organizers went on an unprecedented action, selling two tickets for the price of one. Philip Kirkorov was forced to refuse concerts in Armenia in April 2005: 30 youth organizations in Armenia (including the youth wing of the Dashnaktsutyun party), protesting Kirkorov’s rudeness towards Irina Aroyan, an ethnic Armenian, as well as noting him “ pro-Turkish mood ”, the organizers of the event asked to cancel the singer’s tour. ^{[32] [37] [38] [39] [40] [41]}

Скандал нашёл своеобразное отражение в творчестве Филиппа Киркорова. В июле 2004 года вышел его мини-альбом Сам П…А?! или Kirkorov MaZZDie!!! ^[51] . Основу альбома составили несколько ремиксов популярных композиций эстрадного исполнителя, а также положенные на музыкальное сопровождение фразы певца со скандальной пресс-конференции. Некоторые ремиксы были включены в альбом незаконно, после чего были разбирательства с музыкантом Левоном Атаяном, который не давал Киркорову и его компании "Филипп Киркоров Продакшнз" никаких прав на издание его ремикса "Kirkorov MaZZDie". Одновременно с выпуском альбома певец подготовил новое шоу «Король ремейкOFF» (по названию сингла , вошедшего в упомянутый альбом). В новогодней программе «Первая ночь с Олегом Меньшиковым », появившейся в эфире телеканала НТВ в ночь на 1 января 2005 года , был показан необычный музыкальный номер «А вы-то кто?», связанный со скандалом; в титрах исполнителями композиции были названы Филипп Киркоров и « 2ва самолёта » (авторами композиции являются участники группы). Декорациями исполнителю на сцене (некто в маске, переодетый Киркоровым) служили многочисленные микрофоны, наводящие на мысль о пресс-конференции, а танцовщицы кордебалета с накладными «сиськами» были одеты в розовые кофточки. Вероятно, под маской Киркорова скрывался сам певец (он снимает её в финальном эпизоде на несколько секунд), а маскарад был обусловлен тем, что некоторые поддержавшие бойкот руководители НТВ заявляли, что Киркорова на канале больше никто не увидит ^{[34] [53] [54] [55]} .

Эстрадный номер «А вы-то кто?» повторно появился на телевидении в 2005 году в первоапрельской программе «Бенефис Юрия Гальцева и Елены Воробей », показанной « Первым каналом ». Идея номера, на этот раз решённого в жанре клоунады , осталась прежней, но здесь Филипп Киркоров уже не скрывал своего лица. • Фразу Киркорова «Меня раздражают Ваша розовая кофточка, Ваши сиськи и Ваш микрофон» обыгрывали музыкальные критики накануне концерта певицы P!nk в Москве в 2004 году : «Нам нравятся её розовая кофточка, её сиськи и её микрофон». ^[59]

• У команды КВН «Кефир» (Нягань) была шутка, в которой использовалась фонограмма одной из фраз Киркорова: «А генеральный спонсор нашего выступления — лингвистический центр „Филипп Киркоров“. Лингвистический центр „Филипп Киркоров“ — „Научитесь говорить сначала по-русски!“» ^[64]
• По мнению некоторых критиков российского шоу-бизнеса, скандал на пресс-конференции с Киркоровым был запланирован, так как, по мнению критиков "Автор главного ремикса Левон Атаян, не мог на следующий день уже предоставить слушателям готовый ремикс и раздавать интервью на российских телеканалах, а газета "Дни.Ру" не могла за день организовать акцию против Киркорова" .
