Demarche ( fr. Démarche ) - diplomatic speech of the government or diplomatic bodies of one state before the government of another state.
A demarche may contain a request, a protest, a warning, and the like, and may be expressed in writing or orally. In the practice of the UN Security Council, the delegation’s demonstrative departure from the conference room during a speech by one of the parties to the conflict is used as a demarche. Demarches are used in cases where the usual diplomatic means (negotiations, consultations, etc.) do not help to resolve a particular controversial situation or problem, and the issue requires urgent settlement. The reason for the demarche may be a violation of the territorial integrity of a state, cases of violation of human rights and freedoms, and other situations. An example of a political demarche is the Boycott of the Olympic Games held at different times by many countries.
The form for expressing a demarche can be: [1]
- an official statement by the head of state, any competent state authorities,
- diplomatic note
- recall of the diplomatic representative,
- other forms.
The principles of international law (in particular, paragraph 3 of Article 2 of the UN Charter) do not allow the use of a demarche with the threat of the use of force and with purposes different from maintaining international peace and security. [one]
In the everyday sense, a demarche is an attack, an unexpected, harsh act.
