Material liability

Liability is a legal term , in the general case denoting a person’s obligation to compensate for damage caused to another person. In Russian law, the term is mainly mentioned in the context of labor law.

Liability in labor law is not only the obligation of the employee to compensate the damage caused to the employer (enterprise, institution, organization, individual entrepreneur), but also the obligation of the employer to compensate the damage caused to the employee (as a result of unlawful deprivation of the opportunity to work, for delayed payment of wages ), or his property. Liability is the obligation of the employee to compensate for the damage caused to the enterprise as a result of the violation of its labor duties. It arises immediately after the damage has been done, regardless of whether the employee has been brought to other types of responsibility (disciplinary, administrative, criminal) and the application of other measures of material impact (non-accrual of bonuses for the main results of economic activity, non-payment of remuneration based on the results of work for the year, etc. ) When hiring, a liability agreement is drawn up, which is concluded between the administration and the employee. The contract indicates the rights, duties and responsibilities of each of the parties. The contract is executed in duplicate, the first one remains in the personnel department of the enterprise, the second is transferred to the brigade team, signed by the head of the enterprise and certified with the seal of the business entity. The contract is valid for the entire period of work at this enterprise.

In the brigade form of liability, all members of the brigade have the same right of access to values, participate in the implementation of a range of operations with values ​​and report for them to the accounting department.

Limited liability

Limited liability consists of the obligation of the employee to compensate for the damage to the extent provided by law. This is part of the wage of the worker. Damage in excess of a predetermined limit cannot be recovered from an employee.
