Federal List of Extremist Materials

The concept of “Federal List of Extremist Materials” was introduced by the Federal Law “On Countering Extremist Activities” No. 114-ФЗ dated July 25, 2002. The law defines extremist materials as

documents or information on other media intended for publication, calling for extremist activities or justifying or justifying the need for such activities, including the works of the leaders of the National Socialist Workers Party of Germany, the Nazi Party of Italy, publications substantiating or justifying the national and (or) racial superiority or justifying the practice of committing military or other crimes aimed at the complete or partial destruction any ethnic, social, racial, national or religious group.

According to the amendment adopted in 2015, the exceptions are the Bible , the Qur'an , Tanah, and Ganjur , their contents and quotations from them ^[3] , which were substantiated by the fact that these books form the “spiritual basis” of Christianity , Islam , Judaism and Buddhism - “traditional religions” ", Which" form an integral part of the historical heritage of the peoples of Russia " ^[4] .

At the same time, the law includes, among other things, “mass distribution of obviously extremist materials, as well as their production or storage for the purpose of mass distribution” , as well as financing and “other assistance” to these actions (see Article 1, paragraph 1) ^{[2 ]} .

The law prohibits the distribution, production and storage in order to distribute extremist materials on the territory of the Russian Federation; provides for the recognition of materials as extremist by the federal court at the place of their discovery, distribution or production, their confiscation, and inclusion of materials in the Federal List, which is subject to “placement on the international computer network Internet , as well as publication in the media (Article 13) ^[2] . Initially, the list was supposed to be updated twice a year; in practice, it is updated much more frequently ^[5] .

According to article 20.29 of the Code of Administrative Offenses of the Russian Federation (“Production and distribution of extremist materials”), mass distribution, production or storage for the purpose of mass distribution of materials included in the published list, which entails a fine or administrative arrest for 15 days. Charges are also possible under various criminal articles (for example, article 280 “Public calls for extremist activity” or article 282 “incitement to hatred or enmity, as well as humiliation of human dignity”). According to article 15 of the Law “On Countering Extremist Activities”, the author of extremist materials is recognized as “the person who carried out extremist activities”. Article 13 also provides for enforcement measures such as a “warning about the prohibition of the dissemination of extremist materials” through the media , and suspension or termination of media activities in the event of a failure to comply with the warning (Articles 8 and 11) ^[2] .

Authors and distributors of material are responsible for distributing prohibited materials on the Internet . In March 2008, Alexei Zhafyarov, a representative of the Prosecutor General’s Office , proposed that responsibility be also placed on providers and hosting companies ^[6] . In April, Vyacheslav Sizov, another representative of the Prosecutor General’s Office, described the plan more specifically. According to Sizov, specific sites should be included in the list of banned materials; all Russian providers will have to block access to the banned site for a month after the publication of the list ^[7] . Some legislators, for example, Sergey Mironov ^[8], support the idea.

On May 10, 2011, the Supreme Court of the Russian Federation in its ruling No. 58-Vpr11-2 on the lawsuit of the prosecutor of Khabarovsk against Transtelecom-DV CJSC (Internet service provider) to restrict access to the website page on which recognized extremist materials were posted on The NBP said that, despite the absence of laws providing for specific procedures and conditions for restricting access to Internet sites, the current legislation established the need to restrict access to sites containing extremist material and technical capability to do this at rovaydera had. The Supreme Court overturned the decisions of lower courts, which refused to satisfy the prosecutor’s claim, and sent the case back for new consideration ^[9] .

Some experts believe that due to the unprofessional work of the forensic examination and closed processes, the list includes materials that should not be considered extremist, works of famous authors that are not prohibited in any other country in the world ^[10] . For example, the human rights ombudsman in Russia Vladimir Lukin at one time warned about the absurdity of classifying Said Nursi ’s works as extremism in Russia ^[11] .

Some items of the list are formulated in a way that makes it obviously impossible to identify the material itself, see list items 449 , 392 -401, 428 (and other descriptions of leaflets only by quotes without indicating the time and place of distribution of the leaflet), 674 . In some points, network addresses are indicated incorrectly (point 300 ). In some cases (paragraph 414 ), inaccurate descriptions used lead to curious consequences ^[12] . Such language casts doubt on the competence of the courts that issued the relevant decisions.

The question also arises whether paragraph 414, which contains lengthy quotes from prohibited materials, could itself be recognized as extremist material.

The European Court of Human Rights has communicated complaints about the listing of a number of Muslim publications ^{[13] [14]} .

Paragraph 1081 contains the IP address of a site hosted on Blogger in 2011, which used only a few IP addresses for all (up to 1.3 million) hosted blogs, distinguishing between domain name requests. As a result, in 2012, some requests to any blogs hosted on this hosting were blocked by individual Russian Internet providers ^{[15] [16] [17]} .

In 2015, the UN Human Rights Committee, in its concluding observations on the seventh periodic report of the Russian Federation on compliance with the International Covenant on Civil and Political Rights, expressed concern that “in accordance with the vague and flexible definition of the term“ extremist activity ”as provided for in the Federal The Law on Combating Extremist Activities does not require any manifestation of violence or hatred, and that this law does not contain clear or specific criticism terii, on the basis of which certain materials can qualify as extremist. " ^[18]

As of December 30, 2018, the list includes 4885 items.
